Basic K-1 Visa Questions for I-129F

I am currently filing a K-1 visa form. I have not sent the file yet, though I do have some 'silly' question to be asked since i cannot afford a lawyer because its too expensive around where I live. First, is it required to have the I-129F cover letter? I want to fill it out, but I dont understand some of the basic details like for example [address of filing location] where do I it send it? I have heard about the texas lockbox or the USPS Address. Also, under the cover letter, do we place our Fiance's full name, or can we just place the first and last. Same question about the location for "Fiance of intent". It ask for the address.

I am a student at college and I have been unemployed since November 2014 and since then actively seeking new job opportunity. Assumed that the G-325A is required to be filled out there is one section I dont understand, "Applicant's employment for the last 5 years" Can I also place in what was temporary? I was only there for a month. Can I also include internships? I wasn't paid for work but was accredited through high school for college for 1 year. Does it still count as employment?

First thing: To be precise, you're not filling out a "K-1 visa form"; it's the I-129F petition. The "K-1 visa application" is made later, at the consular level, after USCIS's approval of the I-129F petition.

A cover letter is NOT required. Most people compose one more as a "table of contents" for their own reference. If you want to compose one, you can leave off an address and salutation altogether.

For the letters (plural) of intent, again leave off address and salutation except perhaps for "To whom it concerns:"

You're not worried about the consular phase now except to front-load your I-129F petition package with evidence of your bona fide relationship. (USCIS doesn't care about this but will pass it to the consulate for the eventual visa interview.) The only U.S. consulate in Brazil that's concerned with K-1 visa interviews is Rio de Janeiro.

When you've compiled your I-129F petition package, see the instructions (Guides, atop any VJ page) for the proper address in accordance with how you plan to ship your package. On the outer envelope's address label, add "ORIGINAL I-129F" somewhere visible.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I suggest you read the guides at the top of the page for the K1, there are also examples for the forms- I learned so much from reading these. You won't need anything from your co-sponsor until you receive your NOA1 and NOA2 and are at the embassy stage.

As for the G-325A, provide any employment you've had in the past 5 years, even if it's temporary. Use a correctly labeled attachment sheet if necessary. Don't over think the process and just answer the questions. I think we over-complicate the process in our desire to have everything perfect, so it's understandable.

This is a DIY site, so most people here don't use lawyers (you can do this!)- the guides and examples provide everything you need. We're always here for support and answering questions after you get the general idea and have done your research and still may have questions.

Im sorry Im very new to this as there are so many forms to gather. I try to take it one step per time. I do over think things, but thank you for the answer and correction. I just feel like some of the questions they ask are overwhelming. And again Apolgies for the incorrect term of "K-1 visa form" I didnt know what to call it. I guess you can say every form has their name, hm? I most likely come back if i have more questions. Thanks for the answer.

I should be worried about what contents are inside I-129F. Im afriad to ask because I just feel like a dumba××. Excuse my foul english. Im just afriad of what response I'll get, whether or not I'll be able to understand nor i do not want to sound annoying. Assumed, half the people here are first timers. Im actually real worried about the G-325A.

As I mention when i first started, i only had a temporary job. So as mention according the second poster, i can use those so-called temporaary employment, even though it was just accredited for colleges? I worked there for year. Im also afriad of the affavit of support.

It's ok..calm down, deep breath and take your time !

This is very much a walk, not a sprint. The G-325A is NOT for the purpose of determining if you have enough money! - it is saying who you are, and where you have lived, and where you have worked.

Generally you should always be honest and fill out in full then you have no worries.

Most usually don't need one, unless you have money to burn and want to make the process take longer.

Address is the same as where you mail the 129f petition to which is found in the instructions, ie Texas.

That is for the second Letter of Intent needed for the interview. Use the address of the US Embassy in their country.

No, Read the Guides.

You can list that. Most in your situation list Student and then no employment info.

No. Receiving money income is all that counts as income.

Relax, the process is easier than you think. To answer your questions:

The cover letter is not required. If you are using a cover letter, you do not need to put an address. If you want the letter to look a bit more formal, then you can just put the address of the Texas lockbox. For example, the address section of our cover letter looked like this:

You can put just first and last name for your name and/or your fiancée's name on the cover letter. The full name will be shown on the I-129F form and G-325A forms.

The letter of intent can be addressed the same way as the cover letter. Or, you can choose not to put the addresses. The address is not a requirement for the letter of intent. You only need to have a statement certifying your intent to marry within 90 days of arrival to the US, sign and date it. That's it.

Do not confuse G-325A with the affidavit of support. They are unrelated. For this petition, YOU and your FIANCEE will each fill out a G-325A form and include one passport photo. All the G-325A form is, is simply a brief biographical background history of you and your fiancée. It has nothing to do with filling out an affidavit of support. The employment section is not looked at for eligibility of support, it is simply your employment history.

You can list employment, even if it was temporary. If you were getting paid, then list it. If not, then don't...simply write unemployed. For your internships that were unpaid, just write unemployed for that.

For the I-129F petition, you only need to prove 3 things:

  1. You are a US citizen (include proof such as your passport)
  2. You and your fiancée are both legally free to marry AND are willing to marry each other within 90 days of arrival to the US (include proof such as the letters of intent)
  3. You both have met in person within the last 2 years (include proof such as passport stamps, boarding passes, pictures, etc.)

In addition to the above requirements, you only need to have the required documents filled out and signed completely:

  • I-129F
  • G-325A (for each of you, with a 2x2 passport photo)
