Hello all. I have searched this topic and haven't seen any results that fit my situation. If there is a thread I missed, let me know.

My mother in law is coming from Nigeria on a B2 visa later this year. While she is here we'd like to visit Mexico on vacation. Just need to know if that is allowed and what we need to get done ahead of time. Thanks in advance for any advice or direction to links you can provide.

K-1 process

1. December 19, 2010: Mailed I-129F

2. December 23, 2010: I-129F delivered

3. December 28, 2010: NOA1

4. December 29, 2010: Received email and text message from USCIS stating application was received

5. January 6, 2011: Received hard copy NOA1

6. May 2, 2011: Received email and text message for NOA2

7. May 6, 2011: Received hard copy NOA2

8. May 9, 2011: NVC received approved 129-F

9. May 10, 2011: NVC mailed to Nigeria

10. May 25, 2011: Received packet 3 and interview date of August 10th

11. August 10, 2011: Interview; VISA APPROVED!!!

12. August 29, 2011: POE Houston, TX

13. September 3, 2011: Wedding day

AOS process

1. October 18, 2011: Mailed AOS

2. October 28, 2011: AOS delivered

3. November 1, 2011: Received email and text message from USCIS stating AOS received

4. November 5, 2011: Received I-797C

5. November 22, 2011: Biometrics appointment

6. November 25, 2011: Received letter that case was transferred to California

7. February 21, 2012: Received email of RFE

8. February 25, 2012: Received RFE for completed I-693 (curse the incompetent physician)

9. March 1, 2012: Mailed RFE response

10. March 15, 2012: Green card in production email

Timeline

Call the U.S. port of entry where you'd be coming BACK from Mexico. Ask the question: "My mother-in-law will be visiting from Nigeria on a valid B2 visa. If I take her across your port into Mexico, will she need to show you anything other than this B2 visa in order to be permitted re-entry when we return?"

I phoned the applicable POE with this question about my own mother-in-law, whom we planned to take into Mexico for a day trip, crossing by footbridge. I was told, "As long as she has a valid tourist visa, she'll be permitted re-entry."

Notes:

-- Our plans changed, and we never actually went.

-- I failed to get the name of the CBP agent to whom I'd spoken.

-- My mother-in-law wouldn't have needed a visa to visit Mexico; yours very well might.

There is everything right and proper about phoning a CBP port with questions like these. Go to www.cbp.gov and search for "ports" or "ports of entry." Make the call, and note what you're told and by whom.

Definitely let us know what you learn.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There are 2 events that need to happen , she needs to be allowed into Mexico and she must be able to return to the US. If her visa is single entry then game over. It is used up when she arrives. If it is multi entry then the question is entry to Mexico. I find conflicting info. I do find reference to the allowance of ANYONE with a valid an open US visa ( once again multi entry would be the key ) being allowed into Mexico. I would print the following to show at the border in case the officer doesn't know ( I think the number is the consulate in San Diego )

U.S. or Canadian Citizen or Legal Residents in the U.S.A. and Canada
Citizens or permanent residents of the United States of America or Canada and those with a valid U.S. visa multiplies entries can enter into Mexico if the purpose of his visit is tourism, transit or business with the presentation of your valid passport at the port of entry (air, sea or land) , your card of permanent residence of the United States of America or Canada or valid U.S. visa multiplies entries.

The Mexican immigration authority will provide the migration form FMM, which will permit a temporary stay.

For visas of business with more than 180 days stay, students, retired, those who wish to work or reside in Mexico, shall call:

(619) 308.9953

This will not be over quickly. You will not enjoy this.

Results update: I emailed someone at the Mexican Embassy and they stated that as long as my mother in law has a valid US visa she is not required to get a visa to get into the country. I also just spoke to someone at my local CBP office and he said that as long as her US visa is valid when she returns from Mexico there will be no problems getting back into the US. :dancing:
