Getting Married on ESTA over K1?

Hello Everyone!

So to start off..

I am in the Army and I met my fiance while I was in S.Korea on tour, We became a couple on May 17th of 2014, we dated for several months and she came with me while I was on leave in September to meet my family and visit the US for the first time ever while I was on leave, I decided to pop the question and she gladly accepted! Before she left back to S.Korea we talked about filing for a K1 visa and move a few months down the road~

I submitted a K1 packet for my fiance to immigration back on November 29th to the Dallas lock-box and I never heard anything, So I called sometime in January and it seems the case was accepted for NOA1 on December 3rd, it just seems that my unit loved to send mail back to the sender quite often.

Well we are here almost in June and have yet to receive any updates on our case at all! and it seems that some people have had there cases accepted even after mailing a month after me.

The base I am stationed at (Fort Hood) has this monthly meeting from USCIS where people applying for immigration and visa's can have a One on One with an USCIS representative..

After waiting my number was finally called and I got to talk to the USCIS Rep. I asked him a few questions and I mentioned that it has been 6 months going onto 7 since I filled for K1 and we have not heard a single thing..and he said the most boggling thing that made sense..

He suggested have her come over on an ESTA and get married.

I then asked what about the 30/60/90 rule, and he went on to tell me not to worry about it

"You could get married Day her feet touch ground and apply for green card same day"

I inquired about what if immigration ends up finding out and try to send her back form which he told me that

"Immigration hardly messes with military, if she was to land and marry some Joe whom worked at a McDonalds, right away then they would think something is up"

So, what I am asking VJ has anyone whom already applied for a K1 went ahead and just got married on an ESTA?

I am not surprised that you were told that, but to discuss such a situation is against VJ TOC and will get you into trouble VERY quickly.

No one here is going to recommend you do that, because it's illegal.

Pursue the K-1 path you are on.

I understand this temptation.. Has been painstakingly waiting for 7months and didnt hear any update. My fiancé and I are losing our patience as well!! but we encourage each other everyday. Congratulations!!!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
