EAD card received, but case is "Pending"??? (merged)

We went to Texas DMV to get learner's permit for my wife.

They wanted...and...we provided..

1) EAD card

2) SS card

3) 2 forms of documents dated within last 30 days with her name and address

This was all good.

But when she looks up her EAD card number,

it's showing "legal status" as "pending"...

Therefore, the lady refused to let her take the written test.

I explained to her that her GC is still in processing, so it would show up "pending",

but she didn't care. She says, while in "pending" state, they can't issue learner's permit.

We called USCIS, but they said we have to get infopass and talk to someone.

We tried half dozen times today to get infopass and web site says,

"At this time, there are no information

appointments available for the office in your area.

Please try back again later."

From the paper the DMV office handed me, it appears that

my wife's legal status is "pending" in the SAVE system.

Well...my wife certainly didn't have trouble getting the SS card changed

to the married name after we got the EAD card, so this is bit frustrating.

Has anyone had EAD approve (and have it possession),

but was denied either learner's permit or driver's license?

Timeline

Check your state's online requirements for it. In my state a NOA that proves you filed AOS/EAD is sufficient, it lists the NOA form number as a document

to show.

If you see that online as acceptable proof, take it in and show them the form numbers are the same. Also always ask to speak to a supervisor.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

This is interesting as I will be facing this in a bit. Go to the link here http://www.txdps.state.tx.us/DriverLicense/LawfulStatusDLID.htmand then look for the Verifying Lawful Presence link. The thing I ran across was for AOS applicants you need to present the printout of the I-94 and the I-797.

I think you guys missed the point. The required documents are...

1) EAD (or GC), 2) SS Card, 3) 2 documents (dated within 30 days) with her name and address

And I had all of them, and that's not the issue.

When she looked up the EAD card number in (presumably) SAVE system,

the legal status was set to Pending. Therefore, she told me to get that cleared

with USCIS and come back again.

I tried to explain that her GC is still in processing,

but that she is entitled to get driver's license with EAD.

The lady says, she handles about 20 EAD card based

driver's license a day, so she says she knows about that...

but only when the legal status is set to Pending.

I'm just baffled...its as if EAD is approved and we have the card,

but perhaps SAVE system isn't???

You're right. It's there on page 3.....you should be able to get it. She seems to have been mistaken. Try again with the printed material?......

That's odd... My wife never needed to provide her EAD to receive her drivers learning permit. They obviously confused or giving you the run around. She went in, gave them her State ID,paid fee,took test..done.

Now I do recall the DMV giving her issues trying to get her State ID. Something with the date on her I90. But they were confused, and she went back a week later talked to someone different and received her state ID.

She now has her drivers license. Never once needing her GC, EAD To get her drivers licence or permit. But maybe your state has different laws.

When my wife applied for her first learners permit in Michigan, she was able to take the test and get the permit with her valid I94, SSN, and proof of residency. She took her test, passed and got her permit. That one expired at the end of the 90 day period and we went back with he EAD, and it took us about 4 weeks and two applications before DHS verified her status and she was able to get her second permit without having to retake the test. We weren't able to complete the full license on the first one as I needed to make some repairs to the car prior to the road test, plus I wanted her to do it in the Spring instead. Now she is ready for her road test, so hopefully all will go well when we go back for the license.

The upshot is that the State and Federal governments are not always on the same page when it comes to verifying legal status. I would try again with the EAD, but maybe bring the printout from your 785 status from the USCIS site as well.

Now I do recall the DMV giving her issues trying to get her State ID. Something with the date on her I90. But they were confused, and she went back a week later talked to someone different and received her state ID.

She now has her drivers license. Never once needing her GC, EAD To get her drivers licence or permit. But maybe your state has different laws.

We went to 2 different DMV location at 2 different occasions

and they always wanted EAD or Green Card as the main ID...

Plus...

SS card, and 2 documents with her name and address on it

that was issued within the past 30 days (although the website

says within 90 days).

They also asked for I-94...but that's expired a long ago,

so it didn't come into play for us.

When my wife applied for her first learners permit in Michigan, she was able to take the test and get the permit with her valid I94, SSN, and proof of residency. She took her test, passed and got her permit. That one expired at the end of the 90 day period and we went back with he EAD, and it took us about 4 weeks and two applications before DHS verified her status and she was able to get her second permit without having to retake the test. We weren't able to complete the full license on the first one as I needed to make some repairs to the car prior to the road test, plus I wanted her to do it in the Spring instead. Now she is ready for her road test, so hopefully all will go well when we go back for the license.

The upshot is that the State and Federal governments are not always on the same page when it comes to verifying legal status. I would try again with the EAD, but maybe bring the printout from your 785 status from the USCIS site as well.

Yeah...we have the EAD card on hand, and EAD approval web page print copy,

but apparently...she showed me a screen that says "Legal Status is Pending"...

I saw the screen...

But...of course the status would be "Pending" since she is still in GC processing,

so I just don't get how else my wife could get past this without the GC.

That said, the lady claims that she handles couple dozen EAD card situations a day

so she knows what she is talking about??? (Beee T Chee...)

In any case, after about a dozen attempts, we were finally able to get an infopass

appointment on April 13, so we'll see what this is about.

But we plan to go to another DMV location and give it another try before the infopass appt.

I love America in many aspects, but some of our system and skills/knowledge of our

government workers are rather barely mediocre... Could this be because most of the clerks

usually are just high school graduates and not the sharpest knife in the drawer? :lol:

However...obviously USA is doing something right...since this is the No. 1 country people want to come to...

Yeah...but we had EAD card for 30 days before we went to DMV.

But we just received the letter from DPS which states DHS cleared her

and she can return to get her learner's permit.

03-17-2015 Received SS card with married name
03-17-2015 Started to change all her accounts to married name
03-23-2015 Received potential interview waiver letter
03-27-2015 DMV rejects learner's permit due to "legal status=pending" and vision test failure
03-28-2015 Made InfoPass appointment for April 13th.
04-05-2015 Vision test for learner's permit
04-06-2015 DPS sent us letter that DHS cleared my wife's status to acquire driver's license.
04-07-2015 InfoPass appointment cancelled
04-10-2015 Get Learner's Permit

Please note that having EAD card isn't an automatic guarantee that

you could get Driver's License or Learner's Permit.

In our case, when the DMV clerk checked her legal status online,

it was at "pending" and she refused to let my wife take the learner's permit test

and she submitted security/legal checks to DHS.

After about 1 week, we received a letter from DPS (DMV)

that says DHS has cleared her status and that she can now return

to get her driver's license/learner's permit.

This is probably not a common occurrence, but I just wanted to share with those

that will be going through this in the future...that it can happen.
