Timeline for I-485 filed after I-130 approval (not concurrent filing)?

Dear Members,

Is here anybody who filed I-485 after I-130 approval? How long can it take to get I-485 approved if I-130 approval has been already received prior to I-485 filing? My guess (and hopes) that it will take less time but I would like to hear experience of others.

Please note that in our situation concurrent filing of I-130 and I-485 was not applicable. Thank you in advance.

I-130 (as part of IR-5 process) - USCIS (Nebraska Service Center)

06/09/14 - sent I-130

06/14/14 - NOA 1

11/14/14 - NOA 2 (5 months)

AOS (Local Office: Denver)

03/24/15 - AOS packet sent via USPS Priority Mail (I-485, I-765 & I-131 w/ approved I-130)

03/26/15 - package delivered according to USPS website

04/01/15 - email notifying the AOS package has been received

04/02/15 - an AOS fee withdrawn from a bank account

04/09/15 - received hard copies of all three NOAs (NOAs dated 04/01/15)

04/28/15 - Biometrics

05/08/15 - online status changed to "Case is ready to be scheduled for an interview"

05/18/15 - online status changed to I-765 approved-wait the card in the mail (no change for I-131) (80 days)

05/19/15 - received EAD/AP in the mail

05/28/15 - online status changed to "As of June 28, case is ready to be scheduled for an interview." This is the second time of such change since 05/08/15.

07/05/15 - online status changed to "As of July 5, case is ready to be scheduled for an interview." How many times are they going to update that status, I wonder?

12/18/15 - still waiting!!! For almost 9 months now (261 days from AOS NOA, 234 days from Biometrics).

01/14/16 - submitted "out-of-normal processing time" inquiry and called USCIS that stated the case is still at NBC and "inquiry" should answer why there is such delay.

01/15/16 - 294 days since the AOS was received by the USCIS; 262 days from the biometrics.

01/28/16 - [day 309] received response to case status inquiry (processed on 01/23/15) - "your case is waiting to be scheduled for interview," so wait another 90 days [sigh].

02/21/16 - [day 332] interview scheduled for 03/24/16 [363 days from the receipt of petition].

02/24/16 - [day 363] AOS interview. Approval on the spot.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

thank you for a response. By referring to timeline for Denver office, you mean that the Denver office reviews I-130 as well as I-485, therefore, there is no expedited process for I-485 when I-130 has been already approved? Additionally, AOS process is for a parent (not a spouse). My understanding there will be no interview required. Any thought on that?

Every AOS in the States (except K-1, which has interview waiver) must have an interview. Your I-130 is finished, you don't have to worry about it. Now I-485 needs an interview to be adjusted, and everything is backlogged now. It is coming soon. Good luck.

Timeline

Every AOS in the States (except K-1, which has interview waiver) must have an interview. Your I-130 is finished, you don't have to worry about it. Now I-485 needs an interview to be adjusted, and everything is backlogged now. It is coming soon. Good luck.

Per VJ Member's timelines for recent AOS approvals and my comparisons of timelines reported on the USCIS website for specific local offices, it appears that AOS timelines for local offices is not accurate on the USCIS website. You seem to state similar conclusions in one of your recent posts - i.e by stating that adjustments will take faster than it is shown on the website. I.e. I would not take the USCIS as an accurate indicator of the AOS timeline.

As to interviews, it appears that they are sometimes waived. even though, I would agree with you that they may be required.

Still, it would make sense that an approved I-130 would speed up the process comparing to a concurrent filing of I-130 and I-485, but apparently there are not that many people who have experience similar to mine.

Actually, concurrent filing is way faster than step-by-step I-130 then I-485. Only K-1 AOS interview might be waived.

All cases timeline and USCIS processing time vary, it just gives you some insight. Be patient and it will come before you know it.

Only K-1 AOS interview might be waived.

Just a note:

8 CFR § 245.6 Interview.

Each applicant for adjustment of status under this part shall be interviewed by an immigration officer. This interview may be waived in the case of a child under the age of 14; when the applicant is clearly ineligible under section 245© of the Act or § 245.1 of this chapter; or when it is determined by the Service that an interview is unnecessary.
I.e. the interview can be waived for any applicant (not just AOS from K-1 visa).
You are correct, AOS process requires a lot of patience :(

a lot of AOS cases where the beneficiary and petitioner are parent and child, the interview is waived, not only for K-1 applicants. Its just that they have the right to decide which interviews they waive

*****This visa was approved for my daughter in June of 2016. She came to the US in July 2016 and received her 10-year green card in the mail.

07/24/17 - I-751 mailed to USCIS > 08/09/17 - NOA Received > 09/04/17 - Biometrics Appointment (I think I did a walk-in in August for this) 

01/22/19 - Update on website says green card being produced
