Can I be in the US when my fiance sends the petition?

Hey :) I'm just wondering if I would be able to be present in the US (I am Canadian) when my fiance sends the petition? I noticed on the petition is asks if your fiance is in the US and asks for a arrival/departure record.. I have no idea what that is. Since Canadians don't need a visa to visit, would we just say N/A or what would we need to do?

Yes, you can. I was in the US when we sent the petition. I am sorry but not sure how is the entry for canadians, I assume there is a record or something like that (No electronic I94??), if so that's all you need along with your passport or travel document info, date of arrival and date authorized stay will expire. They don't ask info about Visas but last travel record.

Hi,

you just need to put the information you have. I94 doesn't exist for Canadians.

The only thing that got me puzzled was how to keep track of the number of day in the states on a 12 months period. I didnt really find the information but just make sure you keep track of it in some ways. Technically we are not allow to spend more than 184 days total in the States

Right ok. So he would just explain that I'm from Canada and wasn't issued an arrival/departure record?

I was in US when we filed petition up to the day we got our NOA-2. I beleve your info is still enterred in their system and you can possibly check it here https://i94.cbp.dhs.gov/I94/request.html

I have a nexus and tried putting my info in and it was not found

Interesting. I don't know what to advice then, when I fill in my info I see my full travel history.

Maybe, but I would still call USCIS or/and US Homeland security to find out for sure, better to be 100% sure and not have an RFE later.

What does RFE mean?

RFE=request for evidence, that is when they are missing info or forms are filled out incorrect. Say you leave that section blank-about fiance being in US, but arrival/departure records for Canadians do excist and they check it- then they will send the page back to you and will ask tou to fill it in correct, but that will cause a slight delay in the process, cuz they suspend processing the case until they receive reply from you to their RFE.

Basicly my point is try and find it out right now not to lose time later on.

Do you travel by car or by plane? I think it makes a difference... but not sure. How long are you in the U.S for?
