A few questions before mailing AOS...

Hello everyone :)

I'm almost ready to file my AOS, i just have a few questions:

1. I had all my vaccines on my medical, except Varicella. I've had chicken pox when i was little, and on the DS-3025 it's marked as "Not routinely available". On the bottom is says that all vaccination requirements are complete. So I should be fine without seeing a civil surgeon, right?

2. In form I-131, where it says "On a separate sheet of paper, explain how you qualify for an Advance Parole Document etc etc..." Do I really have to do this? I searched around the forum and it looks like it's not necessary...

3. For the Affidavit of Support, can we use my husband's tax return for 2013 as most recent? He still hasn't filed his 2014 taxes. He will in a week or so, but since I'm ready with the rest of the documents, I prefer to mail the packet asap :) Also, he made a little bit less then 125% of the poverty guidelines in 2013, but this shouldn't be a problem since his current income is above it, right?

4. So on some of the forms (EAD) it asks me for mailing address, and on others it asks me for physical address (AP). Since our mailing and physical address are different (the mailing is just a PO Box) which one should i use for form I-485? I'm assuming the PO Box, since they will mail us stuff along the way, right?

Timeline

1. There are so many different answers you can find everywhere about this. I searched a lot as well to find the answer, some people say to a civil surgeon some say don't, some people get an RFE and some don't so it is hard to say. USCIS says to just submit that form if your medical was done within a year of filling for AOS and if you have all required vacinations so that is what we went for.

2. Again a lot of people say yes and a lot say no. When you file together with form I-485 you don't have to write the explanation letter because you qualify by doing the AOS process. I think that is a question for people who file the I-131 separately from the AOS package.

3. I did the same. Included my 2013 Tax Transcripts because i have not done my taxes yet. Even if i did my taxes it take about 6 weeks for the tax transcripts to post on the IRS website.

4. This one i am not sure about.

A properly filled out DS-3025 would have had VH marked for the varicella which stands for varicella history because you had chickenpox. No, as per the I-131 instructions, this is not a requirement for adjustment applicants. You do not have to state any reason anywhere on the form itself or provide a separate sheet to explain why you want or need the AP.

Yes, you can use the 2013 tax transcript as most recent since he has not yet filed for 2014 and the April 15th filing deadline has not passed yet. Be sure to include proof of his current income meeting the requirement with letter from employer and/or recent pay stubs.

Ow... well at the time of the exam the doctor didn't even asked me about it.. We'll mail it as it is and hope for the best :yes: If we get a RFE for it we'll deal with the civil surgeon. Thanks for the info :)

That is what i said to myself and my wife when sending it out with the DS-3025. Deal with the RFE if it gets here because there simply is no one answer to this. Some people with perfectly filled out DS-3025 forms also get RFE's.
