Should we expect a RFE?

Hello Everyone,

My fiance sent the package on 02/02. We got the NOA1 on 02/10 and now we are waiting for the NOA2.

Checking some posts from people on the forum, I read a guy's case who got an RFE because he had forgotten to tick a box on the I-129F form (Part 2 - Question 15. Has your fiancee ever been in the USA?), and for another thing I do not remember right now . So, I checked the scanned copy of the I-129F package, and noticed that he had missed ticking that box too (all the scan was ok, but this page was illegible, and since it has several questions that dont applied to my case, I didnt check this page thoroughly)

So, my question is, is it likely that we will get a RFE? If so, I have a couple of questions.

1) Does USCIS send him back the whole package he had sent or just the form they need to be completed?

2) How many time will it delay the process?

3) Once we send the RFE, do they accept our case quickly?

I'm both mad and dissapointed :ranting::cry: . I don't know how I could miss that question. I double checked everything because I didnt want any delay, and the only page I didn't check, has the mistake.

Anyway, at least, I know what to expect since now, and I wont get the surprise in a few day when instead of finding an aproval, I find a RFE.

I only hope we can get it soon, so we can fix it soon.

1. They will send you a letter detailing the RFE and what you need to send to complete it.

Most likely will not be the entire form.

2. You have 60 days to respond to an RFE. All depends on how fast you send it back.

3. Not sure what you mean by accept your case, the noa1 was the case acceptance. This would just mean your case is being looked at, but usually I find that approvals are not far behind.

Some advice-

Just because someone received an RFE is no indication that you will.

Worrying and stressing over it will make the process slow.

Just sit back, relax and forget about it for now.

If it happens it happens and you can deal with it when it does.

You've only been waiting three weeks also, be patient.

Timeline

I got an RFE for not matching my fiancee's birthday on 2 separate pages. Stupid mistake on my part. They sent a single page explaining they wanted a birth certificate for evidence of the correct date. I had 90 days to respond. I replied within a week and about 2 weeks later I received NOA2. So, my estimate is it delayed things about 3 weeks or so.

If you receive an RFE, the typical time to respond is 87 days (84 days plus 3 day allotment for mailing). The sooner you respond, the sooner your case can resume processing.

The maximum response time is 12 weeks for an RFE. Extensions of time to submit evidence beyond the 12-week limit for RFEs or the 30-day period for NOIDs are not permitted. The regulations state that when an RFE is served by mail, the response is timely filed if it is received no more than three days after the due date. 8 CFR 103.5a(b) . USCIS has determined that as a matter of policy that additional mailing time should be given to applicants/petitioners residing outside the United States. See Appendix 10-9 for standard mailing times. Extensions of time to submit evidence beyond the 12-week limit for RFEs or the 30-day period for NOIDs are not permitted.

Thanks all you guys for un answers, it is really frustating this situation, I can't believe they don't accept the most minimal error. Well, I guess it is for avoid any kind of fraud. Also, they put the questions kinda hidden, they should think of how to make a form to make it easy for others, so they won't make any mistake, and it's a win-win lol.

Definitely understand your feelings of frustration! I left my fiancé's letter of intent in my copy machine. We just got the RFE letter requesting that over the weekend, and I got it right back into the mail. The instructions in the RFE letter were pretty straightforward at least. We're hoping it only adds about 2 weeks to the whole process.

I hope to get as much 3 weeks of delay. But I have to wait first until they change the status on the web page. I noticed the mistake before they give us the RFE. I feel so anxious. I must calm down

Trust me, you just begun the very first step into this long journey to the US citizenship

and there will be plenty of additional documents to submit,

so don't fret over what's done as it will not improve anything

other than to raise your blood pressure.

Rather, let this be a good lesson to double and triple check

everything in future documents.

It's such a minor error, so perhaps they could oversee (?) it???

But if you get RFE, it should be a simple fix to reply.

I just got my case approved tonight (2 am), without RFE!!!! :dancing:

I had suscribed to USCIS for any update of my case just about 1 hour before, bc I didnt want to check my case twice a day, so, I thought, let's wait until I get an e-mail... and then, I got the email.. I couldnt believe my eyes... I went to the USCIS web page, just to make sure, and yes, my case had been approved....

Im so excited that I want to cry.

One step closer to my bubu :wub:
