Hi everyone,

Just found out about this forum and realy cool that everyone is trying to help each other.

I read some Threads but everyone has a different case so i wanted to be sure about my case.

In my situation:

- I'm 27 years old and a turkish citizen.

- I have a really clean and good background. (Was born in Germany, speak 3 languages, have my bachelor and masters, worked as a teacher for more then 5 years etc.)

- Came on Dec 16th 2014 with a B1/B2 tourist Visa to the US.

- I did a same sex marriage on Feb 18th 2015.

- My Husband is a US Citizen.

- We live in NYC.

- It is not a fake marriage.

- My Intention is to get all documents ASAP done because I'm a teacher and i want to continue with my life, working and not being illegal for some reasons.

My question is:

Which forms do i need to fill? As i read the forum i think i need to fill the forms: (I-130, I-485 and I-765) Can i apply to those forms at the SAME TIME or do we need to follow an order?

Thank you for your help.

Thank you for your help.

Yes, you need to file all those forms I-130, I-485, I-765 and also I-131 if in case you need to leave the US and go back home for an emergency.

Certainly you should send all forms together and have a cover letter and explaing what you are sending, but every document you file has is own requirements and documents you need to submit so make sure you submit everything required for each form.

You can see details for doing Adjustment of Stattus (AOS) and the documents and forms you need to file with here.:

http://www.visajourney.com/content/i130guide2

Try to familiarize yourself with what it is needed, not only here on VJ but in the USCIS website for the forms and instructions for each one..... and read the instructions and look for the forums here for AOS for any help you may need. If you have any specific questions you can always ask here on VJ and I am sure you will get an answer soon.

Good luck to you both and wish you a happy journey!!!! :dancing:

Thank you for your response..

Now i do have 3 more questions...

1) Form I-131 is for, when i need to leave and re-enter the US. In my case i dont need to leave US. Should we anyway process this form?

2) After we married we both took our last names... Should we use our new Last Names on those forms or the old ones how they are listed in our ID's and Passport?

3) Should my husband change his Name on his Social Security card, driver licence, passport before those forms or after?

Thank you for your response..
Now i do have 3 more questions...
Sure I'll try to answer the best I can :-)
1) Form I-131 is for, when i need to leave and re-enter the US. In my case i dont need to leave US. Should we anyway process this form?
This is a judgement call. It all depends on you :-) There is no fee associated with this form so it does not hurt to have it or submitted. If it is granted it will be noted on the EAD card (combo card).
2) After we married we both took our last names... Should we use our new Last Names on those forms or the old ones how they are listed in our ID's and Passport?
I am not sure about this.
3) Should my husband change his Name on his Social Security card, driver licence, passport before those forms or after?
I believe your husband does not have to change his name on all his documents in order to submit the AOS documents, and just fill the AOS forms with the name he wants to show on AED/AP card and Green Card. You can read below for this topic as I believed it was asked before here on VJ and you can also do another search as well see what else you find. Here is the one I found:
Hopefully someone else can reply with more concrete answers for you :-)

methold you are totally right.

All you have to do is to fill all those forms and send them to the lockbox located at Chicago. You also need to go to the Civil Surgeon for the I-693 (Vaccination, Blood Test, etc) and attach the sealed package with your I-485.

It's $1,070 for I-485 that covers the work permit and advance parole (request it because it's free and you never know!)

The I-130 cost $420.

I-130 Petition for alien relative

Copy of birth certificate of beneficiary

Translation of birth certificate of beneficiary

Copy of marriage certificate

Copy of Termination of previous marriage (in case)

Copy of USA Passport of petitioner or U.S. birth certificate or naturalization certificate

I-485 Application to Register Permanent Residence
