(For tuition purpose) What would be my visa status after 90 days from my entry as k-1 visa holder?

Hi, there. I came up with this question while I was looking into state residency for tuition purpose. My fiancee and I are about to file I-129f and I'd like to know what my visa status will be during the process of getting GC in order to see if I'm eligible for in-state tuition.

Will I remain as K-1 visa holder for approximately one year until I get my GC? Or Does it change as I get work permit? Or does it change as I file for AOS?

Please share any of your experience regarding applying for In-state tuition. Thank you!

"K-1" until you file for AoS, then "adjustment of status applicant / pending".

Check with the school to find out their specific requirements for tuition.

I came all the way to this because i found out the school I'm attending to has Immediate residency. I could check it with school tmr but I wanted to find out first what type of visa I would be holding while waiting for my GC. But i guess i have to be permanent residence first to be eligible. FYI it reads as following;

A dependent student of a parent, or the spouse of a person who, as of the first day of classes, has accepted full-time, self-sustaining employment and has established domicile in Ohio for reasons other than gaining the benefit of favorable tuition rate. Documentation will be required.

Note: this is referred to as "Immediate Residency." To apply for reclassification to Ohio resident for-tuition-purposes under this provision, complete and submit the "Immediate Residency Application."

I hope this helps. Thanks all for the replies. :)

Ask them what documentation they require to prove you live there with your spouse and not for tuition purposes only. They may accept your visa/passport and/or receipt notice from filing for AOS along with marriage certificate. Check first to see if you need to wait for permanent residency to be approved.

Agree with KayDeeCee. :thumbs:

State-funded schools may have specific tuition residency requirements. Check out my comment #137 in this K2-related thread: http://www.visajourney.com/forums/topic/287035-calling-all-k-2-aosers-past-and-present/page-10 , to see our experience with college tuition and residency requirements.

Good luck on your immigration journey.
