Wife's I-130 Visa Denied, Joint Sponsor Required

Not surprised but still crushed....I had a joint sponsor lined up but he backed out at the very last second when an immigration attorney told him it was not necessary. I submitted 200k in assets. But since I had no income I thought a joint sponsor would still be needed. I was right and the immigration attorney was clueless.

My wife was also crushed as she took the 9 hour bus ride back home. All I could get out of her was send the joint sponsor forms via DHL. Anyone here go through the same scenario at the interview stage? What steps did you take after securing the joint sponsor? Thanks in advance.

You still needed a joint sponsor even though you had assets of $200,000? On their website, it says you only need three times the poverty line in assets, which for a couple would be around $60,000.

My husband and I were planning on using assets too but after hearing your story, we're quite confused. Your denial goes against the information US immigrations have posted for the AOS.

Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

Provided you included proof of assets that were easily liquifiable then they were more than enough for a household of two.

Just got an approval today based entirely on assets (and less assets than you, but still more than enough for the requirement). I'm very sorry it was rejected for you; I wish I had some clue why that could be. Best of luck with regrouping and moving forward from this setback.

Congrats on you being approved. I had 217k cash with 12 months bank statements. The USCIS says the U.S. consular "may" consider assets. In our case, the consular did not consider it and looked at my no income. We are a family of four so that may have factored in to it.

Thanks. I wish they'd give information, any information at all, about when they would or wouldn't accept assets in place of income.

Its up to the U.S. consular. Yes, I easily had enough assets to be approved but unfortunately the U.S. consular in Nairobi refused the visa petition. I have been retired so I had no recent work history.

I have a job offer that would start in April. Anyone know how long I have to be working before I could submit that as proof of support. Having trouble finding a joint sponsor.
