Hi all,

So a friend of mine was lucky enough to fall in love and has now entered the US on a K1 visa in the same manner that I had too a few months back, I'm now happily married and adjusting my status to LPR, but my friend unfortunately isn't being so lucky. His Fiance's parents are very pushy and don't want them to get married until the very last minute. What he really needs is something official to show them which says that's a bad idea. I know ive read around this site a number of times that you should not leave these things till the last day but can anyone point me at some official docs i can give him that state that fact?

K1 Visa timeline: 12/27/2013 Filed paperwork

12/29/2013 - received at Dallas lockbox

1/2/2014 - Got NOA1 email with case number

1/7/2014 - Received hard copy of NOA1

1/9/2014 - Alien registration number changed

8/1/2014 - NOA2 email

8/11/14 - Petition shipped to NVC

8/22/14 - NVC sent petition to Dublin.

there's a blurb in the I-485 instructions about adjusting from a K-1 visa. but remember the I-485 is a general purpose form, aye?

errata:

1. marry within 90 days of POE date, AOS is ok with just the I-485.

2. marry after 90 days of POE date, AOS needs I-485 + I-130. [more money for filing fees]

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

What do you mean the end of K-1 visa? After the beneficiary entered the US, the K-1 visa is void and no longer can be used. Now he depends on his I-94 expiration date.

I can think of lots of reasons, are they hoping she changes her mind?

Believe me I have already told him this and warned it does not bode well for the future but unfortunately his fiance's parents hold a lot of sway over her and shes finding it difficult to stand up for herself. He already told me that they don't really seem to want to let them get married and are trying to drag this out so that they will go out of status or that they can apply enough pressure, that it will all fall apart. The only thing they agreed to do was back off a little if there was official docs that said you shouldn't delay until very near the end of the K1 90 day marriage period.

He has his I 94 and has to marry and file within that 90 days to maintain status.

Obviously there are work driving issues as well, medical insurance is often a reason for a quick wedding.

Wrong.....they have to marry within the 90 days of the entry.....filing for AOS within that period is best, to avoid becoming illegally/unlawfully status (all of which is waived when they file AOS).

Obviously there are work driving issues as well, medical insurance is often a reason for a quick wedding.

Seems to me that the parents will be part of their lives regardless....your friend has to accept this or not.

Always a good idea to read what somebody posts before commenting.

A Marriage is off to a bad start by listening to others. Who cares what others think. Your Vows are a devotion to each other. Not Parents or other family or friends. If I did it that way and listened to others I would never have my lovely lady today! Point is: If you listen to other opinions. Then you need to be alone.

This probably goes along with not the best advice but for purposes of AOS the two of them can go and get married quietly at City Hall and then have the big wedding later. Seriously, some parents need to open up their minds a bit.
