I am pakistani and residing in United kingdom, my wife is US citizen and we married here in UK, is islamic marriage certificate is acceptible or not when we apply for the spouse visa ?

Yes, There must be a stamp by the authority that its authentic, I think the marriage certificate is in English Language if its not than u have to translate it and should notarized it.

and also ur wife has to change her status ln documents.

If it is not a legal marriage in the place where the marriage occurred, then it's not a legal marriage for US immigration.

It doesn't matter that it's legal under Islamic laws. The marriage has to be legal in the UK.

Its matter that it's legal under Islamic laws, coz in Islamic religion, there is some kind of restriction, so if will a question asked by the I/O during interview in embassy.

they have the knowledge about ur religion.

any way if ur documents are stamped u will be fine.

Your religion is not the determining factor.

A legal marriage is required under US laws.

Please explain to me how an Islamic marriage that is not legal under UK laws satisfy US laws for an immigration visa?

I did not said that if marriage is illegal in UK law and its legal in US.

I mean to say that sometime people (in this case) they marriage in UK and registered marriage in there home country not in UK, for that point it should be notarized and translated.

my marriage took place in Pakistan and wife she did not change her status in her documents, so when i went for interview in embassy that start cross questioning ....., also requested for marriage certificate in English language attested by "Union council " authority and also by lawyer, that the word by word translation is authentic and true.

so that's i ,mean not forget to stamped it, obviously i know that if ur legal marriage is acceptable in ur religion, is acceptable to other embassy.

If you did not have a civil ceremony in UK, you were supposed to file this marriage certificate with the Registrar office. If you did not do that and did not have a civil ceremony, then your marriage is not legally recognised by British Law.

If this is the case, you can register online at the nearest Registrar office for a civil ceremony and have one within a month. I believe there is the option to do it sooner, but that depends on the rules of the local Registrar office.

Also, some mosques in England hold licenses to perform civil ceremonies.

Your marriage was recognised in UK precisely because you were married in Pakistan. English law recognises marriage even if only religious if it happened in the home country, however, marriage done only under religious law inside the UK is not recognised.

So rule of thumb is: overseas Islamic marriages and divorces are generally recognised by the English courts, but domestic ones are not unless they also fulfil the criteria for a valid marriage imposed under English law.

correct, yes of course you can. But without proper registration ie civil ceremony, you only have cohabitant's rights under British law. This has been a very big issue in UK in the past 4 years. People were under the impression that they had legal rights but then came to find out they only had rights as cohabitants. Under British law there is such a thing as cohabitants rights but it is not the same as a legally registered marriage.

This couple needs to check with their local Registrar and not the US Embassy. You want to make sure your marriage is legally recognised under British law.

Your Islamic marriage happened in Pakistan where it is legal.

The OP's Islamic marriage happened in the UK where it is not legal.

Things that are acceptable in ur religion is not always acceptable to others. For example, plural marriages is acceptable in ur religion and legal in some countries, but it is NEVER acceptable at ANY US Embassy.

The Islamic marriage MUST BE LEGAL UNDER THE CIVIL LAWS OF THE COUNTRY WHERE THE MARRIAGE OCCURRED.

You are making incorrect blanket statements.

Most religious weddings do not require a civil service, my understanding in this sort of case they do.
