Advise on CR1 and K1

Hello,

please I need some advise and help. I got married to my lovely wife (u s citzen) Nov last year 2014 in lagos registry court. My wife got back to the states and file for the CR1 application in January 6th for me.

Please when are will likely to get approval?

Also I applied for a tourist visa to visit my wife in January 2014 and was denied. Due to no travel history and no tie back home. Non of my documents where requested for during the interview. I feel I should have applied for the K1 Visa instead.

Please can I apply again for the K1 visa and I hope it wouldn't affect the CR1 application? If yes please what documents should I take to the embassy of the day of interveiw. Also she is coming in march. Can she go in with me if I apply for the K1 visa. And currently I losted my job, will this also affect my visa application if I apply.

K-1 is not an option at all if you already married.

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

You are married so you can not qualify for a K1. A K1 is a fiance visa and it requires you to be single.

Your wife did not file a CR-1 application for you. She filed an I-130 to establish a prima facie relationship that allows you to apply for the CR-1 visa. It takes about 5-8 months to get the I-130 approved. Once the I-130 is approved, then you can file the DS-260 visa application. After submitting more paperwork, then you get an interview at the US Embassy. The entire process takes about a year. If you are put into AP, it could take longer.

As others have said, at this point you are only eligible for a spouse visa, NOT a fiance(e) visa.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Seems your wife has already filed the i-130 and you just have to start putting all the required proof of bonafied marriage together (proof of communications, money transfer joint account etc) it will help your case if you find another job or start a business.

You ask for timeline. Well approval from USCIS (where your petition is now) is a 5 to 10 month wait) than off to NVC which is 3 to 6 months. Than wait for interview and then interview and pickup another month . No issues or problems you are looking at Maybe Nov to Jan having Visa in hand.

Also with no ties and no travel history on that passport getting a tourist Visa is going to almost a 100% failure rate. And now your ties are to the US and your spouse. So it's a waiting situation for you.

You can always apply for a Tourist Visa. It doesn't effect your Application in system at all. But with no job and wife in US. You look like you will not come back. And most times they don't if given the chance.

No to the K1.

No, it does not matter if you don't have a job currently, it will not affect your visa application.

No, she can not go in with you but hand her passport over to the CO and inform them she is waiting outside which will be very helpfull

that she is there. Get as much face time in as you can with her visiting you more, forget the tourist visa, you won't get one.

Approval 12-14 months from initial filing to interview.

What to bring to the interview : lots of communication evidence, boarding tickets, receipts from her visits, lots of photos, Lagos likes family in the photos

too.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
