Overstayed in the past and now I need a waiver, anyone with similar experience?

Hello everyone!

I entered the US on a J1 visa in 2005. Stayed on that visa until 2007, then out of status until 2009. Left the country on my own.

I had two tourist visas denied ever since (2011 and 2014) and found out my ban to get a visa is 10 years.

I applied to a K1 with my fiance. Texas office, NOA1 in october.

Later on we learned about the waiver. There is not much info online.

Can anyone share experiences with it?

-When is the proper time to use the waiver?

-How long did it delay the process?

-What are my chances of my waiver being approved?

Your chances of the waiver being approved are little to none if you cannot prove that your petitioner is experiencing extreme hardship without your presence there.

Timeline

It delays the process because you must be denied a visa before you are told if you can file a waier. It usually means at least a 6mon-1year delay

This will not be over quickly. You will not enjoy this.

We have a similar situation which is posted under I-212 in case you want to take a look. Get a good attorney to file the I-212 waiver. For us, we received approval in about 90 days, then 30 days to be processed within other agencies, and now it's on its way to the embassy for our K1 approval.

I 212 is for deportation ...OP left on her own, when consular interview is

done they will give you a 221g (if eligible) stating waiver needed....then U

need a good waiver atty to do briefs, ...in the U will have to gather proof of

hardships to mate without U, like medical probs etc.....Lizz Cannon is a

waiver atty that give a phone consult free google her, tell her your situation

& ask questions U have....waivers are taking 3-8 mths

you can only hope to get a waiver or your spouse will have to move to your country.
