Changing employers while still at NVC

Timeline

Hi dears,

My hubby who is the petitioner suggests changing employers, for better terms of course. My querry is, will this move affect us at some point. My take is, he waits until we are through....but i have no idea how long he has to wait before he can make that move. The employment letter and pay stubs we are using to support our aos are all from current employer.. we have not yet even mailed the packages but plan to do so next week.

Kindly advice us. Thank you... Love you all!!

No, it will not affect you or your visa.

Actually yes it may.

If you change employers during the process, let's say, after you send in the AOS package to the NVC but before the interview, you must then take a NEW AOS package to interview. If you do it after the visa is granted then as a petitioner, the only thing he must do is notify the USCIS if he moves but not if he changes his job.

NLR...thanks for your input.. putting yourself in my shoe, lol.. how would you advise us? To wait or to go on with the move?

There's a lot of variables but imho unless the new job is a great opportunity and you will miss out by waiting, I would wait for the process to finish first.

if you already have a joint sponsor and you have a new job (and you have no old job), I think you don't need a new AOS for your new employment, but if you don't have a joint sponsor and you have a new job or switch from old job to new job (both jobs meet poverty requirement), you will need a new AOS. but after the interview, I am not sure if it is necessary to notify the immigration office about new employment that's my concern. I don't see any rules on immigration guidelines.

Thanks NLR, i hope i can convince my hubby to hold on the old job for a little longer.

@spousewaitingvisa... We have no joint sponsorship coz we are above the poverty requirement with the current job, (thank God). Because of your insight on having to write up a new AOS, and as NLR has voiced, i am of the opinion that waiting is the only way out.

Yes you do need an new AOS. Anytime the employment or the petitioner's residence changes before the interview (either you get a job or you lose one or you change work places or you move) you need a new AOS. The only time I would not bother changing the AOS would be with a minor increase in pay and you were already over the poverty guidelines.

However once the beneficiary has entered the USA, the petitioner does not need to inform the USCIS about employment changes, only about moving to a new residence.
