Hi All,

Just wondering about something. I lived in Korea for 10 years, and came back to the US in April to get a job and get started on bringing my wife (who is still in Korea) over here. I started working at a job in late July.

My yearly salary is $50,000. However, I only have made about $24,000 by year's end as I have only worked less than half a year. For my AOS, all my tax returns are zero obviously. I do have all my pay stubs and an employment letter stating my yearly salary that I can submit as evidence. Is this sufficient to sponsor her? Do you think I need a joint sponsor as well?

You should be fine. In your 1/2 year you made more than the poverty guideline for a year of 2 people. Present your pay stubs and get a letter from your employer stating your yearly salary. Also you could do your 2014 tax return asap and send that with your AOS.

Your income should be fine. I believe you still have to show tax transcripts, or tax forms(with w-2). Depends on the country on whether it is 0ne year or three year. Of course you will not have 2014 year as that is not file until April

You can also use a letter stating why you did not file taxes.

Foreign income is suppose to be reported on your taxes unless it under a certain amount. I do not know if you made enough over there to report it on taxes or not.

Thanks for your replies, I forgot to mention that I do have a son as well. So my household size is 3. Is that still an issue because my expected income is almost double the poverty limit for 3.

I did file tax returns, and I also filed the 2555, but my income will just show zero because it is foreign income. I didn't come close to the income limit that the IRS would start taxing me on..

Just make sure to include pay stubs and a letter from employer (if possible) to show your current income (not year to date income but projected yearly income) is well above the poverty guidelines. You can line up a joint sponsor if you wish to be on the safe side.

Do I just put what I actually made in 2014, not my projected because I only worked the 6 months in 2014.

In the instructions it say to put current annual income. You will put what you are making at your job for the whole year, not just for the six months worked. You should include an employment verification letter stating when employment started , position and salary, alone with pay stubs

Only putting income for the 6 months you work, will make your current annual income look lower then it actually is

I agree. Put down how much you will make in 2015. Also get a letter from your employer that states that if your pay stubs do not. (My husband's pay stubs did so we did not bother with the letter.)
