Letter asking us for more evidence!! :(

Hi,

i got the request for more evidence letter :(, i am getting everything i can think off together, the letter is asking for more evidence like joint mortgage, insurance, car loans, bill under both names.

All of the above is under my husband's name, we never thought on updating it because we have a joint account where all the payments are made, and he just transferred all his accounts from when he used to rent, to the house we bought.

I got my car as a birthday present from him ( so it was a surprise and he is on the paper work) we do have a friend in common who helped him during the process to keep it as a surprise, and i have pictures of the day he gave me the car.

Questions:

-I do receive coupons and rewards programs mail to our house and under my name, (victoria's secret coupons and rewards, local casinos, bed bath and beyond, credit card offers, my credit card monthly statement) is it worth it to send them this kind of proof with my name and same address? or would this just be a waste of time? ( i don't want to make any agent upset because i am sending unnecessary paper)

-Should i get a letter from our friend telling she helped him organize everything for my car and my birthday and that he did bought it for me as a present?

-Should we update the billing to my name? I've read in the forum that doing so would just bring yellow flags to the agents.

-The home mortgage, as many topics I've been reading, i didn't had credit score or history in the USA, and by the time i was in the process of waiting for my green card, so i didn't had a social security number either.Should i send the paper loans under my husband's name?

Thank you for reading, i am not scare of going to the interview because we don't have anything to hide, but i do want to avoid it if we can, we don't want the extra stress and nerves :s

What evidence did you actually send?

Did you send bank statements showing both your names?

I know it is hard to get utilities in both names. I am not able to do that so I put some stuff in my name and felt that it at least shows we live in the same location with bills coming to both of us for a shared home.

One of the things I did quite easily was add him to my PayPal MasterCard account. PayPal will give you a debit MasterCard that allows you to use the funds in your PayPal account. And you can add another user to it. So I did that as another way to show mixed finances.

Do you have any insurance policies with both names on it?

ON one of our cars that we owned outright (not financed) we went and changed the title to show both our names with Rights of Survivorship on it.

I have found it difficult to put together great evidence too and am not sure that mine will go through without a hitch of some sort.

Hi thank you for the quick answers.

I sent:

-Bank statements: showing both of our names, transfers from my husband's account to mine and expenses for trips we've done together to back up the airplane tickets, itinerary and pictures

-Tax documents: His 2011, 2012 extension

-Evidence of car insurance, showing both of our names

-Flight itineraries

-4 letters of close friends and family (notarized)

-Pictures

-Both driver license

-Family and friends cards and mail sent to both of us

-Costco membership

And that's it, i guess no we don't have actual proof of financial co-mingling. My question is should i add me to the bills now? get insurance and all that now? would it look suspicious? would they still take it if is not been since the time frame they are asking?

Some of the best, and most often overlooked, evidence for ROC is the following:

-- Wills (one from each of you)

-- Medical powers of attorney (ditto)

-- Other ancillary documents associated with will-preparation

-- HIPAA releases

These things are even more valuable in "life" than for ROC. Get these prepared as a priority. Lawyers can help; some people consult self-help sites such as legalzoom.com or nolo.com for templates that are valid for their state of residence.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Where are 2013 tax returns? And 2012 tax return - you indicated extension.

Have medical insurance? Copy the medical cards and include EOBs from your insurance company.

Your best bet now is to explain everything on a cover letter, and send all in you can. Don't bother adding names to billing or statements, only makes things worse (in uscis perspective, you are trying to make up evidences.) The worst situation is an interview, and as you said it is not that bad if you are legit. Good luck.

Adding names now will not be much help; it will look more like an afterthought.

At the same time, realize that USCIS is not there to deny ROC to valid marriages. And they have seen situations - one spouse or the other with bad or no credit.

I would reply with everything you have, trying to attach a concise explanation that sounds credible.

There are always gray areas, Let's say it's right on the razor's edge and whether your spouse bought you a car or not would tip the immigration officer. They can deny you on the basis of inadequate co-mingling of financial assets shown, and no one will overturn them - you just didn't have it. On the other hand, the IO can say "I think I believe this, it all fits together" and they can approve you on a judgment basis and the applicant certainly isn't going to appeal a favorable decision and if it comes up in their review or in a case file review, the IO's boss will ask and the IO will say "I just believed it."

Take a step back and ask yourself what someone would do for window dressing if the case were phony. Then ask yourself if the explanation you're giving would bear that out. Or does it ring true? How long ago was the gift of the car? Is there a reason the title was never changed? Are the cars at least on the same insurance policy?

It's not about form, it's about substance. Do you have a case that makes it easy for an IO to believe you?

In most states, wife's are supposed to be in title -regardess of who is in the mortgage (that is, if the house or a refi happened after marriage. If not, then it is not your house, no matter whether you have a joint account paying for it)

Same with car, in most states, a joint title can be held. I did gave my wife a car too, but we are both in the title.

It seems you do not have much documented proof of financial commingling, and that is the problem.

How about joint filing taxes, other loans where both are in the loan paperwork, benficiary of 401 and/or life insurance, healthcare benefiiary trhu job, trips together (with itineraries).

How about joint filing taxes, other loans where both are in the loan paperwork, benficiary of 401 and/or life insurance, healthcare benefiiary trhu job, trips together (with itineraries).

Any other financial documentation that shows both in same address?

Drivers licenses?

Credit cards/store accounts (such as Lowe's, Walmart) with same account number, each one with each ones name, together with statements (I did black out parts of the numbers)

The key here is to put priority on things/documents that cannot be easily undone (as what I noted above). Life insurance, trusts, do help, but can be revoked easily. Taking you out of title in a house or car is not easy unless you consent, Same with 401 beneficiary, etc.

Thank you all for your answers, i will put everything together and update once i send my paper work and receive an answer back. I will pust a detail list of what i got together so it hopefully will help some people.

All of your answers are really helpful,and make me search for more and get informed. As i said the worse come worse we will got to an interview.
