I'm an American Citizen that's been with his wife in her country for 3 years . Does this mean I can't sponsor her because I haven't filled taxes for 3 years ? I don't have anyone in the US that can be a joint sponsor ? Her I130 petition was approved a week ago .

Head on home, get a job, file your taxes so you can sponsor.

If you are an US citizen you have to file taxes even if overseas assuming you has sufficient income. Also you should be domiciled in the US since the intent of an immigrant visa is family unification and at this time you and your wife are already together. So get back to the US and settle down and get a job so you can meet all these requirements.

yes that is correct. you will need to get a job in USA and sponsor her or find joint-sponsor, or have a huge amount of cash and assets. You will also have to provide Domicile intent.

A few months is likely enough.

Are you working with a a US/ government contractor in Afghanistan? If you get transfered back home with the same company, you can use that,

My wife and I were in the EXACT same situation. Firstly, you need to file tax for the years you have not. DO IT IMMEDIATELY. They will ask for these during you petition.

We didn't know that she needed to file while OS and its been a nightmare.

We had to use a co-sponsor. We have an attorney (Its not necessary, but after going through the Australian immigration for her to become a PR we were just burnt out) He has said we need to start to prove her domicile, she was living with me for 7 years in my country so its a little longer and she basically had no ties to the USA anymore. Because we are a same sex couple we had a different story for not returning sooner as it was not possible for us.

Good luck and feel free to message me and grab my email address if you have any questions.

It is not a stressful experience but it can be if your not organized.

Oh and are you aware of the time line for bringing her over here? You will be able to return but she won't be here for at least a year.

It SUCKS. Def look for a co-sponsor if you can.
