Hi everyone , I have a question. I entered the US in December 2014, and after that my fiance and I got married legally. then I applied for my Social Security card and I have it now, But I have not applied for green card yet. Today I went to get my state ID, I took my I-94, passport with the fiance visa and a letter that shows my current United States address, but they said you have to have 120 days left on your I-94 in order to be issued a state ID. What should I do now? I will have the same problem when I want to get my drivers license. Thank you.

It is depended on your States law about minimum 120 days, here in AZ they give your ID with expiration as same as your authorized stay (I-94 or Visa.) You are urged to file Adjustment of Status, with Work Permit you can have your ID or Driver License. Sorry but there is no way around, you have to use your passport as your ID. Good luck.

If you want to have ID card or driver license, then you need to have Green Card or EAD card along with other documents in your state. K-1 visa has only 3 months on I-94. So you need to file I-485, I-765 and I-131 ( you dont have to file I-131, but its free if you file with I-485 together). I was able to get ID with 1 month left on I-94 and my ID will expire in 4 years without EAD card. However, the driver license is expired on same day with my EAD card ( 1 year )

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.
