January 2015 N-400 filling/ Fee Waiving

Happy New Years Everyone!

Here we go again. Almost time for me to send my N-400 application in. As with my AOS I will need all the help and advice I can get. I appreciate all of you who put the efforts in creating and maintaining this site. To those of you who had helped me in the past and to those who will take from their time to answer my questions or advise me, I am forever grateful and appreciate each one of you. Thank you and God bless you.

On January 15 I will be sending my and my son's application for Naturalization based on the 3 year rule (been married with the same US citizen for 3 years, continuous residence, LPR for 3 years, spouse is US citizen by birth).

Now I have a few question that I am not sure I know the answer to them and I need your help.

1) Anyone in here ever applied to have the fee waived for an application? And did that affect in any way the process?

(Both my son and I, have to apply for naturalization, for a total of approximate $1200 -processing fees and barometric)

We only live on one income right now, making it from paycheck to paycheck, my husband being the only one employed. I am in school, finishing up my two year degree. We have two children 4 and 12, one receiving Medicaid and one CHIP. Just a bit of background info to help with the answers.

2) Should I just wait until we have the money instead of sending the application now?

3) What happens if I don't get to send my application in after the full three years? I guess I am probably okay since I got the unconditional Green card.

1. I don't think your son needs to send anything. He will become US citizen automatically when you do.

3. Absolutely nothing, you can stay as resident till end of your life if you wish, you don't have to become citizen at all...

Thank you kzielu. I appreciate your answer. I will have to find out for sure what all I need to send or not for him. Don't I have to apply for him too though?

your son doesn't apply for citizenship. if he Is under 18 once you become a USC, he will automatically derive citizenship from you

the only thing you will do once you have the certificate is get a US passport for him

now, if you want him to have a certificate, which is optional, once you have your certificate, you can file the N600

the N400 only is for LPR over 18, if he is over 18, then he cannot file the N400 based on the 3 year rule, it is only for spouses of USC, children of USC have to wait for the 5 year rule

but since he is under 18, only the first part applies for him

Thank you aleful! That helps! I appreciate your answer. So will my son be a citizen then? That is great. If I don't have to file for him than that is great. We can afford my part of the fee without having to pay other $585.
