I-864

Hi guys,

I am going to get married soon. I have some question on filling I-864 form. Did somebody fill out this form for AOS K-1 visa?

Do you have some examples I have looked on examples on VJ site But I don`t understand it clear.

Also, check the example forms on how to fill them, and I strongly recommend the read the instructions for each form, you can download the updated forms and their instructions here www.uscis.gov

Remember to have in a hand a copy of the birth certificate (translated in english) of the K1 visa beneficiary.

Part 5: Sponsor's Household Size

This is where you list all members of your household. The most important rule of this section is DO NOT COUNT ANYONE TWICE. It is possible that someone will fit into more than one category, so the biggest rule here is if you already listed someone, then you don't list them again in another category.

Here are the different sections/categories for this part:

1. The person you are sponsoring. For AOSing from a K-1 visa, this is your spouse.

2. Yourself.

3. Your spouse...this part will be ZERO if you already listed your spouse in #1. Remember: Do Not Count Anyone Twice.

4. Any children you have. You must list any children you have whether or not they live with you, whether or not you pay child support, and whether or not you claim them on taxes.

5. Any other dependents you have listed on your most recent tax return.

6. Any other people you have sponsored with the I-864 who you are still obligated to support.

7. If you have a household member (someone who physically lives in the same house as you) who will be filing an I-864A, you will list them here.

8. The total amount from 1 - 7.

The total amount should be reflective of how many people you actually have in your household size count. For example if your household size is just you and your spouse, then #8 should be 2. If you have a larger number, then it is likely you counted someone more than once.
