Visit the US with status RfE

Hi guys

One question,

We filed in June.

And last night we've got an e-mail that they change our status to RfE.

My question:

I'm going to visit my husband dec. 26th.

Will I have any trouble or will they send me back?

I'm really scared about this right now.

You'll be fine. Just bring proof of your ties to Germany (e.g. apartment lease, utility bills, employment letter, pay stubs, return ticket) and a copy of your NOA1 (and maybe of your filed I-130 package if you have one) with you to show that you both started the application process already and you intend to return to Germany after your visit in order to be interviewed there.

Just don't give them the impression that you are coming to the US with the intent to stay and adjust status, so you can abbreviate the whole process (which would be fraud, btw) since you just got an RFE that is delaying the process a little bit.

I know I can visit the US, I was there in Ocotober and had no trouble.

I just thought because of the RFE status I could get some.

You should be fine. Husband and I flew into the US the very day an RFE was issued - no probs. There's always a risk, but as you are from a low visa fraud country, as long as you bring your paperwork along you should be fine.

CBP and USCIS don't talk to each other unless there is something very wrong. The CBP do not know you have an RFE, nor do they care. Go ahead and visit.
