re-entry permit

Hi VJers

Unfortunately I didn't get the happily ever after ending I was hoping for. I've been in the country for almost 3 months now and this week my husband dropped a bomb shell on me, he told me he doesnt love me anymore and itd be best if I moved back home. I have tried pleading with him but his mind is made up, he's done with the relationship. He actually has issues and really should be seeing a therapist but absolutely refuses to. This is what happened with his first wife too, after being married for a year and a half he told her he doesnt want to be married anymore and left. We've been married for a year and a half as well (notice the pattern). I still love my husband very much but I'm going to leave. What I'm scared of is what if I leave and he wants me back? How long can I leave and still be let back into the country? Am I able to get a re-entry permit or have i not been in the country long enough? any help is appreciated thanks.

You are under no obligation to leave the country just because your husband wants you to.

Do you have your plastic green card yet? If so then you can return up to and including the expiry date. If you wish to remain in the US then you will need to file for RoC under a divorce waiver.
