I-129F denied by CSC

I just checked my case status at uscis.gov and it is reporting that the petition was denied and that I will receive a letter at some point explaining why. From what I've read, these letters are not often particularly helpful.

I received an RFE on October 10th which stated that we need to supply "corrected filled out and signed" G325As as the ones we submitted were incorrect. They did not elaborate on the errors, but we found minor ones, corrected and sent them off. They were received October 30th.

Logically, it seems to me that the updated G325a forms must still be incorrect in their eyes, no? If there were something else wrong with the application which results in an actual denial (ie. not a technicality), this could have been done on October 10th - what I mean is, they wouldn't care if the G325 forms were incorrect if it turned out there was some serious problem.

I did have to write asking for a multiple filing waiver - previous fiances came in 1998 (Canada) and 2011 (Europe), and obviously both marriages are ended. I would imagine that if this were the basis for the denial, that could have been done on October 10th, why would they care about the G325 forms at this point.

Is it possible one of us failed a background check of some sort? Any other ideas? From what I've read of the appeal process, it seems best just to re-file.

Honestly your best bet is to marry and file for CR-1 spousal visa. No mucking about with waiver issues if you do that.

CR-1 is definitely a possible alternative, but I still can't help coming to the conclusion that if they denied the multiple filing waiver, that would have been done instead of sending out the RFE.

i thought it was needed if one applied for two I-129Fs in a 2 year period. you've not done that.

Denial letters at this level tell why pretty much. I think you are referring to Denials at the embassy level that people sometime never know why they are denied.

Just wait for the letter and then decide.

I filed 2 k-1's the 2nd one I withdrew. I did the CR1 and took me 18 months to get her here. She is now a US citizen. You may need an attorney to file for you. I found out later they never accepted my cancellation of the 2nd k-1.

You were correct in sending a multiple filing waiver because this is your 3. K1 petition. I don't think the denial has to do with the waiver request though.

Did your fiance sign the G325a form and did you send the original or a copy ?

I sent in an original, signed by her. There was a memo referenced on this website which instructs USCIS staff to waive the requirement for a signed G325 by the beneficiary, and others have confirm this, but as that memo was many years ago (2005 IIRC), I chose to spend the extra few days waiting for a signed copy to come from her.

The only mistakes we found on our G325s were:

1) Originally we wrote "K-1 Visa" as the "form is submitted in connection" form. I updated this to I-129F.

2) Her name at the bottom box of hers was written in Cyrillic letters - a complete brain fart for both of us - I think we saw "write in the native alphabet" above and just continued doing so.

Hate to point the oh so obvious, but constantly worrying and questioning won't make a bit of difference.

No one here can tell you why you were denied, no one here can give you insight because no one knows for sure except for csc.

Just stop fretting and wait for the hard copy.

Then once you know you can ask for help if you don't know how to proceed.

But constant questions over a denial that you don't know the reason for and asking people who won't know the reason won't help.

Just calm down, and wait.

A denial is not the end of the road.

There are options and ways to continue but you first must find out what went wrong and that means waiting for the hard copy.

Cody and Daisy, I'm not freaked out at all, just enjoying some wild speculation while waiting (impatiently) for the formal letter. I thought someone with similar issues (which aren't really red flags, but certainly make the case more complicated than never-married, childless boy meets never-married childless girl) might have had some experiences with USCIS which could be instructive.

Besides, what else are you going to do while waiting other than speculate?

oh, sometimes folk get on a PC and use the advanced search tool here. If the date blocker was successfully removed, then you can get a lot of stuff from using it.

It could be anything, but mistakes usually warrant an RFE.

There's no point trying to question what it is until you know because everyone's case is different.
