K1 interview in 2 weeks... Just found out I'm pregnant!

My fiancé is currently in Peru awaiting his medical appointment (on Wednesday) and then his K1 visa interview (on December 22nd). I just found out a few days ago that I am pregnant (with his child, of course!). Now the panic is setting in...

We met and are both currently employed on a cruise ship. Both of our vacations are scheduled through March 22nd. We plan to get married immediately upon his arrival to the US and then file for adjustment of status and EAD as soon as possible. He needs to get back to work asap so we can afford to have this baby. Would this be reasonable grounds to ask for the EAD to be expedited? I will work as long as possible but I will only be allowed to stay on the ship for so long with my condition. This is really bad timing, but I guess you don't always get to choose when these things happen.

The pregnancy itself may not be enough for an expedite since you have to document financial loss according to their criteria. If you can submit sufficient evidence you can certainly give it a try since I don't think it harms anything. The worst case scenario is that it takes the full 3 months to receive the EAD.

A normal pregnancy is not a valid reason to ask for an expedite from USCIS; if it were then everyone would be - quite literally - doing it.

Maybe something to consider is to cancel the K1 and instead file a CR1. Yes it sucks in many ways. It might depend on how far are you in the pregnancy. It might work, but remember the EAD and AP would take at least 2-3 months, time that he could not leave the country otherwise would have to start over with the CR1

Of course you can try. I know people who expedited/contacted the congressman because got a job offer while waiting and they got their EAD super fast.

So since he has the ship job already he can send a letter saying they need him, plus the baby thing :)

Pregnancy doesn't mean that you have to quit working yourself unless advised to do so. Two bosses I've had didn't quit working until they literally went into labour. The US system doesn't really allow for time beforehand.

It should only take 90 days at most to get the EAD after filing for the AOS and with a job offer it can be expedited.

You may be able to get it expedited if your fiancé receives a job offer that is contingent on him getting EAD. I don't know if the pregnancy alone would be enough. See this thread:

Pregnancy alone won't expedite it but you can try and prove you'll be under extreme financial hardship once the baby arrives
