hi guyss

i have 1 ques.
i am coming in jan 2015 in usa on fiancee visa and our marriage is on 1 February 2015
but i have to go back my home country in february just for 2 weeks for my sis. marriage (can i go on same fiancee visa?)
or i have to apply for any other visa to visit my home country ?

please help me .............

You have choices:

  • You can delay entering the US until after your sister's wedding
  • You can miss your sister's wedding
  • You can enter the US with the K-1 visa, get married, go to sister's wedding, and start over with the CR-1 visa

That being said, the K-1 visa is a one-time use visa. Once you enter the US the K-1 is no longer valid. If you leave the US after using it you cannot use it again to re-enter the US. When you enter the US you marry, file for AOS and AP, once you get your AP (advance parole) you are permitted to leave the US for periods of time and the AP is your authorization to re-enter the US while you wait for the green card. If you leave without AP you will need a new visa to return.

All of this. You cannot enter on a K1 and turn around and leave. Well, you can, but you'll be back at square one with visa/immigration.

Belinda outlined your options clearly above. I'd suggest waiting until after your sister's wedding to come to the US on your K1 and have your own wedding.

Once you get the visa you typically have 6 months to use it to enter the US. So the answer would be yes. Check the expiration date on your visa when you get it.

That should be fine. The K1 typically expires 6 months from the date of the medical. From your timeline, it seems your medical was probably September or October. Each embassy is different, so check the expiration date printed on the visa in your passport once you get your passport returned.

like i am in newzealand on work permit is there any problem if i can get my fiancee visa in new zealand (us embassy) after get fiancee visa

,i go to my home country for 2 months to aatend my sis marriage ?

and than after attend my sis marriage instead go to nz i will go to usa direct from my home country on fiancee visa ?

beacuse after 2 months i only left 4 months right ?

can you please let me know how long AP will take to approve?

Hopefully someone else can confirm, but I don't think there is any issue going NZ to your home country to the US.

THE EAD/AP forms will be filed with AOS once you're married and should take up to 90 days to be received.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

as ChicagoSarah said, expect around 90 days from your filing date for I-131/I-765 approval when filed together with I-485 AOS package,you must first get married and receive certified copy of marriage certificate to file AOS,also, if you plan to file quickly it is a good idea for you`re fiancé to begin preparing for the AOS, forms and supporting evidences....also,as you will file early in 2015, make sure your fiancé has complete copy of his 2014 tax returns to file with AOS,not sure on how quickly transcripts are available that time of year.
