k1 has been 8 months and deciding to just get married thoughts? help?

Hey Guys,

So it has been 8 months since we filed ( march 19) and still no word.. our lawyer has sent thru a request and immigration got back to him today and somehow they screwed up the number.. so he got someone elses update. I am just frustrated.. now the thing is me and fiancé are both Canadian.. and we were thinking about getting married Legally in Canada and then filing for an AOS??? thoughts?? I feel like our lawyer just made us do the k1 route to get more money.

Oh really!! :( arghh I guess I will keep waiting.. I just don't know why ours is past the normal processing time.. we have more then enough to back it up.. considering I go back and fourth every 9 days.. we even own a house down there together.. its just frustrating!

You wouldn't be able to AOS if you got married in Canada. It would just change the path and reset your clock. You're best off waiting for your K1 now. You've done the main chunk of waiting now, you're almost there I'm sure. :)

You don't need to keep using your lawyer, either, if you think he's fleecing you. Do the AOS on your own with the guides and forums here.

3rd May 2013 - Married in London
7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production
27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed
26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Are you both from Canada?? I thought you have to be USC to do K-1 visa

Just stick with K-1. You waited that long anyway so just hang in there. Maybe since they got the number issue sorted, everything can move along now. I'm a little confused though, how did the lawyer end up with another person's updates?

Why don't you just call USCIS yourself to see what is going on?

19-Sept-14: I-129F Delivered

23-Sept-14: NOA1 (I-797C ~ Texas Lockbox accepted I-129F)

24-Sept-14: NOA1 (E-mail & Text)

Sent to California Service Center

3-Nov-14: Requested expedite by mailed letter with UN Human Rights Reports (Humanitarian Situation)

14-Nov-14: NOA2 (I-129F Petition Approved ~ E-mail & Text)

1-Dec-14: NVC Received Case

2-Dec-14: NVC Case Number Assigned

9-Dec-14: Embassy Received

3-Feb-15: "Package 3" Received/Turned In

25-Feb-15: "Package 4" - Received Interview Date

19-Mar-15: Interview ~ Approved

27-Mar-15: Visa Issued

Why don't you just call USCIS yourself to see what is going on?

This ... :yes: ... sounds like he is doing nothing for his money. Call them and ask to speak to a Tier 2... at this point you should be getting some definite activity on your file

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number
Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .
I-129F Sent : Jul 28 2014
TSC received: Aug 04 2014
I-129F NOA1 : Aug 06 2014
I-129F NOA2 : Feb 25 2015 (NOA2 copy rcd: Mar 02)

PLEASE, do not go through that 12-16 month duration, of I-130, as you have a clerical error, and will be repaired promptly.,.,I am sure.

Stay with your K-1, yes, you would be very happy for two weeks, then, YOU BOTH will realize what you have done.,.,.,..,1 to 1 1/2 years.,..,of waiting, and more costs and paper work, with just a month or two to go?

Stay the course..,..,K-1 is the only way, if you qualify!

I agree.....get rid of the lawyer. Even though you are waiting for the K1, the bulk of the time has passed. Getting married resets everything to another year.

We got a lawyer for the initial I-129f which was important, however for the AOS we did it ourselves and saved a chunk of money...

Do yourself a favor and call USCIS for yourself and verify that their were no RFE's or issues with your petitions. Put in a Service Request. Make a INFOpass appointment. You are way pass normal processing. Time to be proactive now. Are you registered on the uscis.gov website with YOUR email and phone for texting? Or does everything got through your lawyer (mistake.)?
