Our case just got complicated

Hi all,

So far the everything in the visa process has been going smoothly. But now the fiancee and I have hit a snag in our case.

When I filed the I-129F petition for my fiancée she was working in the UAE. Her residence visa expires Dec 2015 however as of recently she is no longer employed which I assume means her residence status will be canceled. She also had residence in UAE from 2009 to 2012. NVC has already sent our case to the Embassy in Abu Dhabi. Also the Embassy or Consulate in her native country (Kyrgyzstan) does not process k1 visas for fiancees or immigrant visas for that matter. I believe that Kazakhstan is the nearest country that has an embassy that processes K1 visas and even that comes with its challenges. Basically Im trying to see if anyone knows if she can still do her interview in UAE since her country does not process k1 visas and its already been routed there? Will the push for transfer to somewhere else that does process visas? Should I contact the embassy with this issue? Thanks for the help and suggestions everyone!

Until when is her last working date in here company. There will be at least 1 month grace period where she can stay legally in UAE after the visa cancellation.

I don't know how much longer you need till the visa is issued. But maybe your fiancé can ask her employer not to cancel her visa yet until she has interview date or until she gets the K1 visa.

I agree with C & S, ask the employer to let her keep the Residency Visa until the K-1 is issued, employers are known to do this for a variety of reasons.

Oh that's awsome! The interview date is so close but feels like a long way away. I'm hoping for successful interviews for both of us!

Yes it is. I was hoping for earlier date cause I still need to give 45 days notice to my company.

But at least I still have time to prepare and at least it’s almost over now.

Did your fiancé sorted our her residency thing in UAE?

She wasn't able to get her employer to extend her time , but I think we will still be ok. She has had a residency visa there for years and her country doesn't have an embassy that process visas so she would have had to leave her country to do an interview at a consulate outside her native country anyway.
