I-129f petition DENIED

Hi,

Hope everyone is well I need advise if I should or not appeal my case on Nov 8 I received the email stating that our application was denied I received the letter today stating the reason for the denial that not enough evidence was submitted for intent of marriage. We hired a lawyer to help us with the process in which I feel right now like she was useless. Do not know what to do. And for what it seem its better looking in here for advise rather than going to a lawyer. To appeal its 630.00 or should I just redo the K1 visa or get married. The wait is a major factor just want to be together asap.

I-129F: Arrived at Lewisville 9/8/2014

I-129F: NOA1 Text message/mail 9/11/2014

I-129F: Alien Registration Number Changed 9/16/2014

I-129F: Request to correct on document or notice assigned to an officer for response 10/25/2014

I-129F: Name Change request made 10/31/2014

I-129F: Crickets as of today

Did you both send in signed statements that you would get married within 90 days? Up to you whether you go the K-1 route again or the I-130 route, but I would not appeal nor would I use your lawyer. Might want to just do the I-130 as that will show you really did have the intent to get married, plus your spouse would get a GC upon entering the US rather than having to spend the $1070 to file for adjustment of status (AOS) after getting married.

Thanks Dave, we both did give our lawyer a letter of intent of marriage they also stated that we was to include statement, wedding preparations, or other evidence that clearly establishes the beneficiary's intent to marry the petitioner. In which my lawyer did not requested

No they sent my lawyer RFE and that the out come after sumitting

Laywers are downright terrible when it comes to K1 or Marriage visas. Don't use one again. Your lawyer didn't send something he should have known to send,

I'm alittle confused here. Are you saying you filed a simple 129-F and you included separate letters of intent with signed signatures to marry within 90 of entry and denied for that?

The 129-F does not ask for other details such as arrangements. Whats missing here? If in fact you were denied a K-1 NOA1 I would get ahold of USCIS and make a INFOPASS Appointment if that's the case.

Did you guys also send a bunch of evidence of the relationship - the "why" you want to get married part?

If one of you had a prior marriage and some documentation for the marriage or the divorce was missing, they might be questioning whether you're legally able to get married.

April 27, 2016: I-751 mailed

May 2: I-751 received

May ??? NOA1

May 12: Check cashed

May 31: Biometrics appointment scheduled

June 1: Biometrics appointment letter arrives!

June 2: Biometrics walk-in

An attorney is a waste of time and money!

this site is all you need, IF you will file your K-1 as the guides here show.

THEN, when you are ready to re-file, read your file over word for word, page by page, at least 5 times! Cover letter, with table of contents, letters of intent to marry,.,.,.etc.,.,..,.,FOLLOW the guides on this site!

Ask questions if you are not sure, people here will help you prepare your own K-1.,...,.,.,.,,please do not do CR-1.,,..,.,that is 12-16 months, K-1 is 4-6.,.,.sometimes a little more, sometimes a little less!

The first thing I would do is ask the lawyer to show me the hard copy of the RFE and make sure that they responded appropriately. It seems like every lawyer horror story involves them not responding to an RFE appropriately (or at all). It's unbelievable and inexcusable, really.

4-6 months from start to finish for a K-1 is only an accurate estimate for the best-case scenario of going to CSC and the rest of the process going very smoothly. The OP would be at TSC, so this would not be the case for him/her.

... yes. this.... there seems to be no clear reason for the denial if you both sent a letter of intent. You don't have to supply details of marriage arrangements etc. In view of the delays in the process how could anyone accurately make those decisions prior to approval. If you both completed letters of intent, then it is something else. Best to find out what it is before taking the next step.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

I know this a little off topic, but I heard of there being a list of banned lawyers, being lawyers that have been excluded from representing or assisting with the immigration process here in the US, I personally am not using a lawyer so haven't searched for the list but I think its something well worth looking into for people who intend on using a lawyer. I personally feel there is no need for one as long as you both have clean records meet the requirements and can gather the information, it just takes time to read all the instructions on all the forms.

12/24/2014.................forms i130, i485, i765, i131 mailed via usps12/26/2014.................forms delivered01/05/2015.................NOA1 for all forms wth 26th dec as priority date01/24/2015.................bio apt received for 02/0601/26/2015................. walk in bio failed, supervisor said that the office is way to busy to come back closer to my apt date02/06/2015................. completed biometrics02/11/2015.................Aos status update 'case is ready to be scheduled for an interview'<p>02/24/2015................EAD updated to 'card in production' AP updated to case approved

09/17/2015....... interview scheduled for OCT 21st.

10/21/2015....... attended interview, approved on the spot, also received updates on case status.

10/23/2015...... green card mailed
