Dear masters of the immigration process, hello to all!

My name is Calin and my wife and I are living in Romania. My wife is a US citizen and she petitioned for my immigration with the USCIS. We have sent all the required documents and are now in the checklist phase. I have looked through the forum and could not find a post with our simmilar problem. Maybe you could help us or point us to an answer. Your assistance will be deeply appreciated.

So, here it goes:

1. On the I-864 form we wrote that my wife is unemployed since 2010. Her income has been 0 since then as she was living in Romania with her sister in the past 4 years, so she has not filed a tax return with the IRS in this time. We managed to get a transcript from the IRS of her latest tax return, from 2010. According to the IRS you don’t need to file a tax return when you don’t have an income.

2. On the I-863 form, on "most recent tax year", we wrote 2010 (Part 6, question 13a) and submitted the above mentioned tax returns we got from the IRS by mail in Romania.

3. I have my cousin, a U.S. citizen in the U.S, who filed as a joint sponsor, considering my wife's income could not meet the minimum poverty guidlines.

Now, a few things to consider before I ask my question:

4. I have a steady income in Romania of about 20.000$/year. I have provided documents to show that this income will continue even if I will not reside in Romania. Therefore, on Part 6, question 6c and 10 of the I-864 form, I wrote my current income.

5. Combined, my wife and I have about 75.000$ in assets (land, a house in the country and around 15.000 in savings) that can be proven with documents. We chose not to include these assets in the original Affidavit of Support because we thought that my current income and my cousin's joint sponsor would suffice, but

today we have got a checklist e-mail from the NVC, stating:

My questions are:

a)Should we resend my wife’s I-864 with “N/A” at item 13.a from Part 6, since she hasn’t filed her taxes for the past 4 years?

b)How can we prove US domicile if we live in Romania and the whole point of my immigration is to move to the US and the timing of our departure is inextricably linked with the date of my admission?

Should we rent an apartment from now, even though we don’t know at what point we will be arriving in the US?

c) Is it a good idea to include our assets(property+savings) in the I-864 Affidavit of Support form considering our joint sponsor is making about 5 times the minimum poverty quota?

hi

you didn't have to put anything of yours on the i864, the i864 is all about your wife's income not yours, she has a joint sponsor to cover for you that will file another i864 as joint sponsor

delete everything that you put about yourself

did your wife include a letter stating that she didn't work, therefore she didn't need to file taxes?

The assets you stated would probably be deemed insufficient or disallowed (if the terms of the I-864 were not met for whatever reason, the government probably couldn't put liens on foreign land or houses on foreign land the same way they could in the US).

In a nutshell, leave out the assets.

September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package

I-864 se refera la info despre sotia ta.

Din pacate nu iti pot raspunde la toate intrebarile dar o sa-ti spun cum am facut eu. Sunt cetatean american si locuiesc in Romania de aproape 2 ani pentru ca am vrut sa fiu alaturi de sotul meu in lungul proces de obtinerea al vizei. La fel ca si sotia ta, a trebuit sa dovedesc la NVC ca inca am rezidenta in U.S.A (ca nu m-am mutat pt. totdeauna in Romania). Am trimis extrasuri de cont bancar care sa arate contul activ. Chiar de nu am mai folosit practic cardurile de acolo aici in Romania, totusi le aveam active si am dovedit asta. Apoi pt ca nu am mai completat taxele am scris o scrisoare la NVC in care am explicat de ce nu le-am completat. Am mai trimis si o scrisoare scrisa de fosta mea menegera in care ea spunea ca ma asteapta la munca imediat ce ma intorsc in U.S. Ca jobul il pot relua imediat ce ajung.

Pe langa asta am facut si o copie de pe ID-ul meu de acolo ca sa vada adresa mea.Nu stiu daca asta a ajutat totusi.

Thank you aleful, Ryan H and Rebecca.

After finally getting an agent on the phone, we have sent them a letter explaining my wife's unemployment and another explaining our current situation and declaring in good faith that my wife will be relocating to the U.S. as soon as I am approved. Also explained that we have looked but due to the inextricable link between my admission date and the date of our arrival in the US it wouldn't have made financial sense to rent an apartment from now and neither to yet apply for a job. I have reiterated that my cousin(the joint sponsor) has offered to house us but we will be choosing California and in that sense we have attached a hotel reservation in San Diego, in my wife's name, from from 15 to 25 January 2015, just enough time until we can find something more permanent. I have also attached a letter from our bank, confirming our savings, just to show we are serious about moving. We hope that will suffice and are looking forward for our interview date.
