Delay in I 130 approval

Hello,

I 130 was filed with NVC - priority date January 14th 2014. Have made several calls to USCIS. Finally got an answer saying its been delayed due to back ground check from FBI.

You could try writing a Congressman from your state to see if they can assist in speeding things up for you. Be sure to tell them that they said it was because of a background check. I have a hard time seeing how a background check needs almost a year to complete.

Our lawyer have been trying to get an answer from them since August but could not get past usual call center. Finally got a custom email from NVC mentioning pending background checks. Lawyer again called and this time spoke to an immigration officer who also said the same thing " FBI background check is pending for both husband and wife". Spouse is US citizen, how can it be pending for both at the same time?

They have to check both, regardless of whether one is a USC or not. In some rare cases on here the visa was denied because the USC was the one who had a felony in their background check instead of the intending immigrant.

Agreed but both can not be pending at the same time. I have been to US before, provided my SS # as well.

Well like I said if a lawyer can't get you anywhere then try asking a Congressman to have one of their reps contact them.

My lawyer said they don't check the beneficiary. I went through all this last year. They only tell you its pending background checks to buy time. My file sat for 10.5 months before they touched it, then I got the background excuse, then I was told by the senator's office that nothing can be done or expedited if it is pending background checks. (How convenient) The I130s have been slowing down lately. All you can do is wait. And I don't think you filed your I130 at NVC. Do you mean NSC?

I thought of same by the way they have been responding and giving lame excuses. I have read somewhere on other blog site that they do background checks for both and there was an instant where they denied petition due criminal involvement of the beneficiary. When did you get your approval? How long did it take them to approve your petition? Yes, you are right, filed with Nebraska service center.

We had similar situation last year. It took 10 months to get the approval.If your file is transfered to local Office,get Info pass and when you visit the local USCIS office try to set up an appointment with Immigration Officer.

No elected official can or will "speed things up" if it's a background check. there is nothing anyone can do to get around it or expedite it, it has to run it;s course
