I-864, joint sponsor, or establish own US income for it?

I am wondering, has anyone had a I-864 declined for some reason, and then moved back to USA (from abroad) to secure a job and re-apply from within the USA? If so, were you successful and how long do you need your job to apply again? Would we only need to resubmit the I-864, or start over again (I assume only the I-864?)

I think we should be fine for the AoS I-864 as we have over 5x's what they require in assets (assets are in Australia, no USA income and cash is only minor there), but I just want a backup plan in case. We have family on stand-by to sign for my husband to come over with the income requirement, but I am not entirely sure that their income would be sufficient for the 3x poverty level amount, so we thought if it comes to it I could get a job earning well over what is required. I am just worried as to how long we would need to be apart for the process to be re-applied and approved.

Does anyone have any experience?

It may not come to that (and I pray it does not!!), but we want to be prepared and have a plan just in case. And knowing the timeframe would also ease our minds (for example, would a month's of paycheques showing we are above the requirement for income allow me to sponsor him from within the US?)

FYI - we both live in Australia, met and married in Australia. I as the USC have lived in Australia for nearly ten years. Tax etc all up to date.

Your income doesn't have to be 3 X guideline amount. Only if you are using assets and savings.

A Co-Sponsor has to meet the same criteria of the guidleine for their household # plus the immigrant.

If at interview you were given a 221g to get a co-sponsor you usually are given a year to produce the documents.

I know Australia accepts assets so if you have 5x (you only need 3X) you are find. But I would have your co-sponsor file out the I-864 and supply all the evidence for backup so there is no delay at interview.

Thanks, I do know you don't need 3x times the poverty level for income, so I shouldn't have put that. Got a bit mixed up sorry.

I will ask my family what the income is, however the ones who were going to sponsor us just had a 2nd child, which brings the household size to 5 (including my husband), and results in his income needing to be around $35,000 and I'm not sure they would have that.

Therefore we wanted a backup plan where I just go over and get the us based income so we can just do it all ourselves. I was wondering how long I would need to be employed for the income to be accepted so we were apart for the shortest length of time.

Because you have 5x the amount in foreign assets you should be okay. Liquidate as much as you can before the interview.

Thanks, We are listing the house on the market in two weeks, and trying to sale some motor vehicles so should have the cash from those by the interview time (Fingers crossed!!) if they sale in time
