Filing K1 for Same Sex couple living in together outside the US

Good Day All,

I'd like to know if it's possible for both of us, My Fiance' and I who have been living in thailand for a year now and working here can process a K1 visa ?

First Q is: What would be the address in the US we're gonna use My USC boyfriend has no house in the US.

Second Q: Is it ok to send the I-129f from Thailand to TEXAS Lockbox?

Third Q: How about the Consulate or Embassy I'll have my interview? Can I be interviewed in Thailand though I am not a thai citizen?

I am hoping for your reply. I have been scanning through this forum but I couldn't find any appropriate answers to my questions.

I read somewhere that the I-129F can be sent to the Dallas Lockbox if filing from abroad, I just don't know if you have to prove or reestablish your domicile in the US.

1)It's imperative for ur fiance to have an american address, if not he can use his parents addr, without an us addr the proccess cant be done, if he doesn have any addr he should rent an appartment or something on his name there

2) yes , ur fiance can send the petition from there but having an addrs in USA

3) it doesnt matter where u are in the world, when u write the petition u have to type where u will have the interview, the only bad thing with that is that u need to transl all of ur docs for the ambassy in english or Thai ... oh and dont forget u will need ur both thai and ur origin country police records

I think we might use his parents address.

I am from PHil and not thai and I work here, and so I think its fine to have our interview here in THAILAND.

I dont have any problems with the translation of my docs coz its all in English though.

I dont think DCF applies to us coz we are not a citizen of Thailand, both My boyfriend and I. DCF only applies to couples who've been living and resident of a certain country. If im not mistaken.

we are both not legal citizen or permanent resident of thailand though, we been here for 2 years and we have a working visa status only. do you think thats possible ??

I believe that would be considered being a legal resident, because you have a valid visa that is enabling you to live in the country, even if it's only temporarily.

It's like someone with a student or work visa here in the US, they are legal residents because they have a valid visa to be living in the country temporarily, they are just not permanent residents.

In any case, you can always find out from the embassy directly if you qualify for DCF.

Living in the country with a valid visa doesn't qualify people for DCF. They have to have the correct type visa that allows them to be considered legal residents.

Hi Guys,

Thanks alot for the info. I still couldnt find any information on how we can start our filing to the embassy if its possible. Its still really vague. We, my boyfriend and I have been staying here in Thailand for more than a year now with valid visa like work and student visa. We dont have problems with all that. But does DCF require any certain things like has to have a work in the US or job offer there,. Thanks alot for the help we appreciate it.
