Hello,

Quick question.

After returning from abroad, I have a new job. I have only been employed for a month, however I have a long-term contract with my employer. I earn over the poverty guideline. I'm just wondering what I need to send in the AOS packet. Below is what I can provide:

-Tax returns from past three years (I was a student until 2013 (so low income there), worked abroad part of 2014 (no taxes filed yet obviously).

-Letter from employer stating a two year contract, salary information, employment information

-First pay stub from my employer (gross yearly income is $20,000 - so it is overr the Federal Poverty Guidelines)

- I also have $16,000 in savings

- I also freelance outside of work, which rougly earns $800 - $1400 a month (how would I even report this?)

Will the above be sufficent? I am currently making above the federal poverty guidelines with my current job. I just do not have many pay stubs to exhibit that. However, my employer can vouch that the terms of my contract are for the long term. I have no plans on leaving my job either.

You should get a co-sponsor regardless.

Because one your current is borderline just above and last year you were below. Many embassies look at previous and present. Line up a co-sponsor just to be on the safe side.

Well technically, I was working in Israel abroad and my salary was well above the poverty line. I started my job in in Israel last October and on my previous Tax return it shows that. I completed that job in August in order to come work in the states. I just don't have a tax return for the months of Janurary - August 2014 because I didn't file those taxes yet. I'm going to write that in my cover letter. From what I heard, what matters is current income. My employer also said that he will write a strong letter regarding the duration of my employment, the contract period, renewal details, salary information, and promotional options.

Sorry, and I forgot to add that my freelance income is not included in the $20,000 a year. The freelance income adds another $800-$1400 a month.

You still need to report your free lance income. If you're being paid under the table that doesn't help you.

As of right now, you should line up a joint sponsor in case it's needed, but submit your pay stubs, a letter from employer, copy of contract, with the I-864.

Oh no, I'm not being paid under the table. I report my earnings from freelance work too.

If I were earning $24,000 a year from my employment + freelance income, would that be be a situation that may not require a joint sponsor?

Overseas income does not count. As far as your cover letter, information about your employment is not necessary. That comes after your NO2. It will be disregarded. Save your employers letter or at the very least date it closer to your NOA2.

full disclosure. The NOA2 I am referring to is for the K1 visa. In terms of the marriage visa, I am not sure when it is necessary to present employment information. For the K1 visa it is after the NOA2 and is separate from the I-129F application.

OMG! I'm in the exact same boat! Student until 2013 and worked abroad this year until now...I'm afraid to file for the k-3 and waste over a thousand dollars because I will have had my job for just two months...

Has anybody had any experience with this?
