B1/B2 visa.

Hi, good day everyone!

I'm creating this topic because yesterday i was refused that i don't have strong ties to my country. Consular officer asked only few questions, like: "Where are you going?, Why are you going there?" after that he started to ask where i work right now and where i study, this thing was my concern, because i don't have a job right now and finished my study three years ago, i had a job actually, i just wanted to take vacation between jobs, because in my job there's no vacation, i worked two years there. After that i said i don't have any job right now and don't have sons and wife here, he refused the B1/B2 visa for me. Now, i'm planning to reapply the interview on October 17, but with two proves that will show my ties to my country, it's my house in my city, which is under my name(q: should I show him my house documents to him if he even don't ask me?), and my mother's letter that will show that I'm her only son and she needs me.

Where i'm gonna travel, it's a New York City from Kazakhstan for 30 days by my friend's invitation.

I don't know where i should ask for help anymore, please, this vacation is important to me dear people. Because friend is my girlfriend and we love each other so much and we wanted to spend some good time in 30 days. I know, for interview person job, martial status are more important, but can i get a visa showing these two my things which I described above? About house, it's a my house and i have documents that shows that it's my property, and i have to pay for taxes for that house, but i live in my mother's home, because she's alone, isn't that enough for them that i'm my mother's only son and i have my own house here? I'm sure, i need to come back to my country after this vacation, because of mother and house.

Sorry about your denial.

They have to presume an intent to immigrate and that is where evidence you need to provide comes in.

In my opinion (others can post as well), only the house is proof of a tie. Other evidence would include documents showing you are paying taxes for that house, bank accounts with balances, a job you would need to return to; wife and children to return to. You don't have many of those.

Not sure that a letter from your mother would have any effect, I believe not.

What you need to be prepared to answer is : What can you show to prove that you are coming back?

When you say girlfriend, Is this in a romantic way? Or just friends and she happens to be a woman?

This is what would be in the mind of the consular officer: you have no job to go back, no wife or children to go back; you'll visit your girlfriend, you will stay and marry perhaps, then adjust status and never return to your country, you will then make a petition for your mother.

You need to overcome that by proving with hard evidence you are coming back.

Your mother living alone and needing you is not sufficient in my opinion.

Unfortunately, without hard evidence, you might be denied again.

There is a an inevitable temptation to mention Borat, but it seems you have no obvious ties and have a compelling reason to stay in the US.

Might be better for your GF to visit you.

Have you traveled elsewhere? Go to a 1st world country for vacation and then try again. My girlfriend's friend got one although she doesnt have a job, just a business that makes no money. Her trip to France helped a lot.

Borat, wasn't a serious reply, sorry. I've read that each county has their own culture taken into consideration to a degree. With this knowledge it important to know that he's an only son whose father is hospitalized and his mother alone at the moment. He will present a letter from his mother as a strong family tie to his country along with the property ownership. Thank you, for your reply, Boiler, actually you are more helpful than I originally thought because this is exactly the no-holes-barred approach of immigration so we must learn to deal with it.

I have not been to Kazakhstan, you have, you no doubt have a much better idea how often unemployed locals vacation in the US.

Having said that he can apply for a B2 as often as he wants and it would not be prejudicial to any future immigration petition. How his Mother is a tie in for a B2 but you also are looking at a K1 escapes me, but I presume that is not something you will be mentioning.

Anyway on a more positive side I have seen reports where people have obtained a B2 in unusual circumstances so never say never, it is after all a human decision.

It would be helpful if you were more familiar with B2 requirements, it states "strong family ties" as a reason to return to the homeland.

"Strong ties differ from country to country, city to city, individual to individual. Some examples of ties can be a job, a house, a family, a bank account. “Ties” are the various aspects of your life that bind you to your country of residence: your possessions, employment, social and family relationships."

Well moving on the strongest Mother Son tie I can think of is Howard in the Big Bang Theory and eventually after many episodes he did move out.

I guess most people think of Spouses/Children when considering family ties, I moved to the US with both Parents living, I assume most people leave Parents behind.

They have been threads where people have re applied with seemingly nothing much changed and have obtained a visa. You are of course never quite sure what happens or even the full details,the nature of the Internet.

His country its the custom for a male member of the family to speak for the woman (his mother), as his father is very ill in the hospital at this time. He has no siblings.

I told you earlier if you travel to a first world country and apply for a US visa after your chances increase.
