Hello Everyone,

Thanks in advance for reading and responding. Guys i have a unique situation and I need some help. My spouse visa has reached the NVC and I have paid the invoice fee for $88 . Currently I am unemployed and not collecting unemployment. Has anyone come across something like this where they know if I can file my 864 without being employed and just providing my tax returns for pass three years and my banks details . Also which form should I file in order if I am currently unemployed.

You're probably best to file the full i864 form. You may run into trouble because it asks for current income, of which you have none. Probably you'll need a joint sponsor unless you get a new job.

But wont I be in trouble regarding income and it will be rejected.

Probably... But that's regardless of what form you fill out. You don't currently qualify to sponsor. That's why you'll need to get a joint sponsor, unless you find another job right away.

I will make my question easy for everyone to understand being unemployed can i use a help of a sponsor to file my I-864.

I'm trying to make this as clear as I can.

You as the petitioner must fill in an i864.

Your i864/a will not be sufficient by itself, since you are unemployed (unless you get a new job)

So,

You will have to find a joint sponsor who fulfills the financial qualifications.

That person will also fill in an I 864.

You will submit both i864s to NVC.

You will still fill out the I-864cbecause you are the petitioner the Sponsor you would just be putting $0 in current. Your previous 3 years at this point is no matter because you clearly don't have money to support. Unless you have money in the back that's #times what you need. So if its just two of you that's $19662 X 3= $58986 you need sitting in the back to qualify on assets/savings.

If no assets/savings or job means you need a co-sponsor so they would also fill out a I-864 and make enough for their household plus the immigrant.,
