Quick Co-Sponsor Q for the good old I-864

Hi Guys,

A quick question I am hoping some light could be shed on.

Our application was recently approved and received by the NVC, so we are scrambling to get the next steps fully ready. The key ingredient here is the I-864 form:

My wife (the US citizen) is a student, so we dont fulfull the income requirements.

Therefore if i read form I-864 correctly, we need to add a household member as a co-sponsor. This is slightly confusing because when we move to the US our household will only be me and her?

That household member then completes form I-864A which we file with my wifes I-864 and we are all good. Hopefully this sounds correct to now.

Key question: Our preferred co-sponsor is not a relative (Godfather), is this permissible for the form/application. If so they would seem to fall under the 'other dependant' category when specifying the relationship - though this doesnt really make sense, since they are not a dependant.

The I-864a is for people who claim to have the same primary residence as you. If your wife claims to be living with you then she will fill out her own I-864 and whoever else (family or friend) wants to joint-sponsor will fill out a second I-864.

Myself: US citizen; Husband: German citizen

-(then fiance) H-2B work visa application terminated due to qualification difficulties in Aug. 2010.

-(then fiance) B-2 tourist visa denied due to lack of strong ties to Germany in Sept. 2010.
-Third ESTA denied due to his suspiscious visa status on Oct. 15, 2012.
-B-2 tourist visa approved on Nov. 16, 2012!

 

(IR-1 Journey):

 

 

-Extended German residence permit obtained Aug. 23, 2014. (to qualify for DCF)

-Husband's new German passport picked up Aug. 28, 2014. (Old one expires 2015)

-I-130 packet sent to Frankfurt (DCF) Aug. 29, 2014!

-NOA1 issued Sept. 9, 2014 (received Sept.13)

-RFE regarding evidence of bona fide marriage received along with NOA1

-RFE reply packet sent to Frankfurt Sept. 30, 2014

-E-mail response (NOA2) received by USCIS Frankfurt on Oct. 23, 2014 (Petition APPROVED Oct. 20!!!) :dancing:

-Paper NOA2 received in the mail Oct. 29, 2014

-Case number assigned by IV unit Oct. 30, 2014 (Received by email Nov. 3)

-Paper "Packet 3" arrived in mail Nov. 4, 2014

-DS-260 and Document Delivery Registration submitted to Frankfurt Nov. 4, 2014

-Mailed in priority date request found on Packet 3 to IV Unit Nov. 5, 2014

-IV ("Packet 3") package sent to Frankfurt Nov. 17, 2014

-Medical completed by Frankfurt panel physician Nov. 17, 2014

-Received "Packet 4" via e-mail Nov. 20, 2014

-Interview booked for Dec. 3, 2014 (booked Nov. 21, 2014 after email authorization received)
-Visa approved, issued AND picked up by the courier all within 7 hours, Dec. 3, 2014

-Visa packet arrived in the mail Dec. 4, 2014

-Visa packet had to be returned to Frankfurt for correction on Immigrant Data Summary sheet (wrong birthplace listed) Dec. 5, 2014

-Corrected visa packet received in the mail Dec. 11, 2014

-POE (through Dublin, Ireland) Jan. 18, 2015

-Registered manually for social security Jan. 27, 2015

The co-sponsor does not have to be a household member or a relative. Heck you don't even have to know them. It's their household size plus the immigrants. So Godfather is a go long as he meets the poverty guideline

Ah i see, so just two separate I-864's needed. That makes sense.

There doesn't seem to be anywhere that you can specify that there will be a co-sponsor, hence two forms - or is this just self-evident by the fact that you are submitting two forms.

On the i864 one of the first questions is about who is filling it out: the petitioner will check "petitioner" and the godfather will check "I am the only joint sponsor."

So on the petitioners form our household will be 2 (me + her) and on the godfathers it will be one.

No godfather will be including the immigrant since they are co-sponsoring. Their household size plus one.
