Timeline

I have 2 questions,

1) I am a US citizen currently living and working in Korea and my fiance who is Chinese, has her interview at the embassy in Guangzhou in 2 days. We have both booked the same flight on December 25th to fly to the US which is the day that I am allowed to return back to the States after my contract is finished here in Korea. Will there be any problem when the interview officer asks my fiance why I am not in the States at the time of her interview? Will she need to show them proof (other than our airline tickets that I am returning?) Will this raise red flags?

2) If they deny my fiance at her interview for reasons like the one above, will she be able to interview again soon or will we have to wait a while? Will they even say why they rejected her if they do? Just a little anxious over this whole thing :)

not an expert hopefully someone will be able to 100% but from what i've read on here etc, is that a lot of people have been with beneficiary at time of interview, but when i have read this it has been for a visit/support reasons. so i don't see it being a issue. could be wrong since its work reasons

you said that you have a contract until the date of flights, maybe if you wanted to have proof could you get a copy if you dont already have one of that contract as well as flight details that you mentioned.

for the interview stage if it gets denied for what ever reason i believe you would have to reapply but depending on the reason they would give you stand high chance of being denied again. again hopefully there is someone else that can confirm 100%.

I don't think he would have to reapply, doesn't it get sent back to USCIS for reaffirmation or something and they have to decide if they want to send it to the embassy again?

6/26/2014 - I-130 Received and signed for at USCIS

7/1/2014 - E-mail of acceptance with Receipt number - NoA 1 (Routed to California Service Center)

07/15/2014 - Change of Address via phone call with USCIS, confirmation via e-mail.

7/30/2014 - I-130 Approved at USCIS - NoA 2 E-mail

08/13/2014 - NVC Received Approved I-130 package from USCIS

08/21/2014 - Case Number and IIN created at NVC

08/25/2014 - Case Number and IIN received via phone call. DS-261 Available and completed online.

8/26/2014 - AoS Fee invoiced and paid online.

8/28/2014 - AoS Invoice status PAID

09/04/2014 - Expedite Request response - Must enter Beneficiary Date of Birth - Re-sent exact e-mail with requested info

09/10/2014 - Expedite Request e-mail received as "Under Review"

09/11/2014 - Expedite Request Approved - Confirmation via e-mail from U.S. Embassy in Bucharest, Romania

09/16/2014 - Embassy Received Case from NVC

09/16/2014 - Received E-mail from Embassy to Schedule our Interview and prepare documents

9/23/2014 - Medical Exam at Regina Maria - Results OK

10/01/2014 - Visa Approved!

10/03/2014 - Received Passport with Visa!

11/2/2104 - PoE Atlanta - Welcome to the US!

11/5/2014 - Paid $165 ELIS Fee

8/1/2016 - I-751 Packet sent in for Removal of Conditions!

8/15/2016 - Notice of Action 1 for I-751 - California Service Center

9/29/2016 - Received Biometrics Appointment

no it is expired at this point. reapplying or marrying and then filing for CR-1 is the option after.

if it gets denied they would recieve reasoning as to why it was denied. depending on that reason a K-1 would most likely be denied again for same reason so marrying would be the best (depending on that reason)

I also am filing from abroad. It depends on the embassy... some embassies want to see "Intent to re-establish domicile" from the USC. Plane tickets, moving plans, rental agreement in the US, US based bank accounts, state driver's license, voter registration, job offer for USC, etc. And from what I've seen if yours does want that and she doesn't have it, they have her come in again and submit it (I think there is a technical term for it, but I don't know what it is).

Do you have a co-sponsor since you don't have US based income? Have you been filing your US taxes?

4/6/15- Package received

4/9/15- NOA1- text/email

4/13/15- NOA1 hard copy EAD/AP (NOA1 dated 4/7)

4/14/15- NOA1 hard copy AOS (NOA1 dated 4/7)

4/17/15- Biometrics Letter received

4/29/15- Biometrics completed

6/23/15 (Day 77)- Service request

7/2/15 (Day 86)- Service request complete, email of approval of EAD (approved on June 30)

12/29/15- Interview
