Bring nephew by adopting him

Hi

It might have been already answered on this topic but couldn't able to find the relevant thread so started my own.

I just became a USC and I want to bring my nephew in immigration visa. He is just 6 yrs old now. I know I can't file petition for my nephew in family category but is there a way that I can bring him to US like by adopting him. If yes what will be the process and how difficult it would be? He hasn't stayed with me for 2 years continuously though. So beside this 2 yrs of living relationship what are the other things I need to consider if I adopt him.

Please guide me if there is any other good option to this case.

Your nephew needs to be an orphan. You up to killing off his parents. Immigration knows about fake adoptions of close relatives and prevents these from happening in all but rare cases. No line cutting for cute little relatives.

This will not be over quickly. You will not enjoy this.

The US wont grant visas for those using adoption of a

means to petition a family member wherein the childs

both parents are alive & well

Yes. That is the quickest way.

If you want to bring him over as an international student, be prepared to pay tuition of $10,000 to 20,000 per year. For public school, he can only attend one year of high school if he pays the $10,000 to $20,000 tuition. No public school from grades K-8.

To adopt and bring him over, you need to meet all of the following;

1. 2 years of living with you after the adoption in the home country. Hard for you to do and keep your LPR status.

2. Proof that at least one parent is dead. No way around this. If there is a surviving parent, proof that the parent can not care for the child in accordance with local standards.

3. Proof that the adoption was not motivated by immigration.

Ok so during this 12-year process of my petition for my brother along with my sister-in-law and nephew,

- will there be any possibility to get deny in any other visa category in case they apply?

- If he and/or nephew get chance to visit the US in other visa category, will it affect this process later?

Also, can I file two separate petitions for my parents and brother within small time interval (say within a month)?

You can file as many petitions as you have people to petition for and can afford to support when the time comes. For example my husband has 21 mostly married siblings and we could apply for all if they wanted to come

This will not be over quickly. You will not enjoy this.
