Good Evening everyone, hope you're all good and happy :)

So after 10 months of processing, I will move to the US to be with my wife, but as the time comes; more issues seems to need our attention, I apologize if my questions are repeated, leaving in less than a week and don't have much time to research,,, So I applied for a job online and got several interviews in September, one of them is not in the state my wife lives in, its a really catchy job and I have a good chance, my wife can't move coz of her job, so we were thinking that I can take that job and go back to her on weekends since its like 6 driving hours away, Sooo I was wondering;

will there be a problem if I didn't live at the address I provided when I applied?

Will they ask me where I'm going to live or give an address at the Port of Entry?

what about driving licence? can I get it before I get my Social security number? and can I get it in another state that was provided in my Application?

should I notify the USCIS about changing my address ?

any advise on what I should do to avoid any kind of problems in the future.

and I have only 3 hours at the Port of entry (Philadelphia airport) then have to be on another flight, is it ok? or I need more time? I'll land at 8 am.

I just hope I get a job at my wife's state, will make everything easier wont it?

To work or get a drivers licence you need a social security number first.

Yupp, I will get it after 3 weeks of my arrival, I told the company that I intend to work with that, and they said its ok.

I am going to make an assumption here: you and your wife have been married for less than two years--correct :time:

So you will need to file for removal of conditions (ROC) after having been in the US as a LPR for 2 years. Your window to file starts 90 days before your 2 year GC expires. The USCIS will want to see proof of a bona fide marriage, so you need to keep records that even though you are living apart, you and your wife consider yourselves a couple and the only reason you are apart is due to your job situation.

You will need to go to the SSA office near you and apply for your SSN ASAP so you can give that to your employer. You need to check on the state you will be a resident in for the DL information. If you reside in KS you must get a KS DL even though MO is right next door. Most DMVs require some sort of proof you live in the state like a utility bill or car registration mailed to a physical address. You must always keep the USCIS appraised of you physical and mailing addresses until you become a USC. You wife must notify them of a change of address using the I-865 until the I-864 is not long enforceable.

It is doable, but you need to document the whole process and it might be a good idea to draw up a Will and Medical Power of Attorney and a Power of Attorney for each other and to put each other as beneficiary on the others retirement accounts and life insurance policies.

Hi everyone, i'm sorry to butt in, but would this not raise red flags with immigration if he moves 6 hours away from the person he received the visa to be with, his wife, in the first place? I'm not trying to judge your situation by any means, I was just concerned that going to a job interview the same month you arrive six hours away from your spouse, who you are there on a CR1 visa for, would cause major immigration issues? Correct me if i'm wrong, but you do have to do an Adjustment of Status interview at some point, right? How would you explain immediately taking a job offer six hours away and only visiting your wife, the U.S. Citizen, on the weekend?

Personally, I would avoid the out-of-state job at all costs. You spent 10 months apart from each other and I couldn't imagine any genuine visa applicant/petitioner on this page wanting to see their spouse take a job that far away after arriving for a couple of weeks. Not only that, but it could be perceived like you are there for employment opportunities instead of being with your spouse. Not only that, getting a SSN isn't as easy as walking in to the office and saying "Hi, i'm here and i'm new, can I have my card please?" It takes a bit of time and processing and if you do ANY work before you can fill out the W-9 (That is the employee tax sheet for employers right?) then you've just committed your first crime in the states.

You really need to consult an immigration lawyer before you make any kind of decision like this, but from one person to another person, it sounds like you've been apart for 10 months already, and that is far too long for any genuinely married couple.

Thanks you guys for the replies, I read everything you said and while reading i felt really bad, I'm not gonna be away from my wife even for a fantastic job, I will stay with my wife, will tell her about my decision right now, being away will complicate everything, it's been a hard time on us and won't make it any harder...I've been thinking about it a lot, and it sound complicated, so I'm staying with my love...

This is really all wrong. Lots of couples have applied for ROC and been approved living apart. Jobs and school sometimes necessitate that.

The POE question is three hours enough? I dont for sure but I do know that planes run late and potential hold ups could occur. I myself was runnng for a last boarding. I had a few delays several times... so I would suggest you give yourself alot o time in a POE I suggested to my husband 5-6 hours just to be sure and his POE will be Philadelphia as well. When I arrived in the US I remember two lines one for citizens and non citizens... needless to say the non citizen line was longer and slower and very slow to be exact. So just be aware there are delays and try to plan for these when booking tickets

A CR1/IR1 visa hold does the AOS during the visa process before the visa is issued. Since this is done at the NVC it is one reason for the PI if you need a co-sponsor most say to get married and then apply for a spousal visa as the NVC accepts co-sponsors and the Embassy in the PI does not--but I digress. The next dealing the OP will have with the USCIS is the ROC stage. His situation is not normal, but as long as he can show good reason for them to be separated and the marriage is legitimate they will be successful with the ROC. It may get a bit more scrutiny than most, but it just requires a bit more documentation and planning.

I am so glad you have changed your mind I agree with everything that Anna Maria and Dave has said. I could not imagine my husband being gone after so long apart. Weekends...no way!

I'm sorry I did not do more research on working without a SSN after having applied, I was referring to avoiding taxes which is a separate topic all together.

That is what I was referring too when I mentioned perceived as something other than a legit marriage. As you can see, living at a different address than your spouse is a possible key to get you sent to the Fraud unit for further questioning.
