Writing your local representative

Has anyone ever written their local representative to bring attention to their case?

Who did you write to, and what was the result?

My husband has been waiting in Canada since February. My petition has been approved and we sent the DS260 August 7th. (We will be dealing with the Montreal consulate). We have zero indication on how long it will be until he can live with us again.

We have a four year old and just had a baby in April, who he has barely seen in the five months she's been alive. My kids need their father above all. This is , and it seems like no one knows about it. Every time I mention the situation to anyone, they are astonished of how long it is taking, let alone that he is not allowed to be here with us. Even if it doesn't speed up the process I think the testimonial would be of some value, right?

Average time seems to be about a year. Presumably your Husband can visit?

Based on current nvc processing times, I suggest an interview date on or about 24 October, with visa packet in hands no later than 8 November, 2014.

But that's my extrapolation, based on current processing times at NVC, in the NVC monthly threads. I could, of course, be dead wrong.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Also it takes 60 days to review each portion of the NVC packages. You can call the NVC to get updates and see if they've reviewed your packages yet.

Well it's a 14 hour drive and he has to keep a job up there to support himself and help us. So we've seen him a total of about 30 days in 7 months. You're children are only babies once. It is precious time lost. I really think only parents separated from their kids can understand that grief...hell I can't really even wrap my brain around it since it's not me.

I didn't know about calling the NVC though. Thank you!

So they usually schedule the interview pretty quickly then? We were worried they may set the date way out for some reason. Thank you for this estimate...even if it is wrong it helps a lot.

when a casefile is complete, it's lobbed over to the end of the next queue, the scheduling queue.

once it's there, it waits it's turn in the queue. scheduling usually occurs within 20 to 45 days of getting into the queue, with an interview date set 15 to 40 days past the scheduling date.

I dunno, NLR helped to remind me about that 60 day bucket. grrr.

Ugh. I just want to know why he can't wait it out here. He'd be allowed to collect paternity leave from Canada so it wouldn't even be an issue of him not supporting himself. And he'd be helping me go back to work. And the kicker is that he already had a green card when we were first married and legally returned it when we lived in Canada for some time.Why is it that when we were newlywed and did adjustment of status it took 5 months total and he was allowed to be here...but now we've been married 4 years with 2 kids and it's 10x more difficult? What the actual eff??

So would contacting congress do anything in your opinion? Also would I be looking at my local congressional district for the immigration liason staffer?

I doubt it would help, as other people have been waiting longer, and sometimes in more difficult circumstances-- there was someone posting on the NVC thread last month who had not yet seen his baby daughter... but it wouldn't hurt to try. And anything that raises public awareness of the problem could be a good thing... I find a lot of people flat out don't believe me when I tell them how slow and difficult the process is... they tend to hint that I must just not doing it right. :P

I suppose it depends on you district, but if your congressional representative isn't helpful you might check with senators... it seems like here in California they have a lot of staff dedicated to helping with immigration issues

He can visit for 6 months at a time,and it sounds like your are in the home stretch. Why would visiting not work? Is there any reason he cannot collect his paternity leave pay while visiting you?

The complicated part would be the point of entry and the potential for questions in proving ties that would take him back to Canada if his residence is closed and his job is gone..not sure about his particular details.

The content available on a site dedicated to bringing folks to America should not be promoting racial discord, euro-supremacy, discrimination based on religion , exclusion of groups from immigration based on where they were born, disenfranchisement of voters rights based on how they might vote.

I don't think it would hurt if the processing time has gone beyond the times stated by the agency or the process appears to be broken down. ( It does not appear to be the case here though) Also are there any special medical needs of the family that might require the support of the Father? ( it seems that many infants do have some need) That might be worth adding weight to the OP case to expedite, leaving a child without medical support is bad optics for any agency or representative.

I don't think it would hurt if the processing time has gone beyond the times stated by the agency or the process appears to be broken down. ( It does not appear to be the case here though) Also are there any special medical needs of the family that might require the support of the Father? ( it seems that many infants do have some need) That might be worth adding weight to the OP case to expedite, leaving a child without medical support is bad optics for any agency or representative.

We are within the normal limits for processing time I think. It is just that the process itself takes way too long to begin with. My daughter has severe GERD that gave her pneumonia at 3 weeks old and has had us visiting several GI and pulmonary specialists to diagnose and treat. I don't know if that would hold any weight, but it certainly has made the separation more difficult.

That is the issue exactly. Since we don't know exactly when he'll get the interview, if he breaks his ties in Canada it leaves us open for all kinds of problems. The first few times he came to visit they questioned him for hours at the border and he always had to provide proof of employment and residence. Now they usually let him by because he tells them that he is only coming for a week visit and that he still has his job. I doubt they'd take too kindly to him saying he's coming for 6 months to wait out the visa process.
