Divorce decree, have a problem

My usc wife is living abroad with me. We were married abroad. She was once married before and divorced in 2003,California.

She has dual citizenship (Us and Croatian). Now, for I130 we have to obtain divorce decree. She doesnt have US divorce decree. She just have a copy of file where is says that she is divorced...no stamps etc.Can we enclose translated Croatian recognition of divorce?

You are going to need an official copy of the divorce decree. You can call the town or county clerk's office and get a copy mailed to you (and if you are going to do that, you might as well get multiple copies in case you need them). You will likely have to pay extra to have it mailed overseas.

An RFE will be issued that will ask for a copy of the official decree.

It is better to get a certified copy of her divorce decree. It will not take that much time or much of money but will save you months of waiting time when you get RFE .

I know...but she is abroad here with me. We don't have a clue how to get certified copy by mail from superior court in Sacramento,CA:/

We sent them an email, but there is no answer. We will ask the embassy here if they can help us somehow.

Make a call to them via Skype. I'm sure the phone number is on the court's website, or the county's site. The embassy isn't going to help you. You need the official decree straight from the clerk's office and that will require a call. If you only send the Croatian item you will get an RFE and delay your petition.

Pay their fee and get it mailed.

Also try looking at the website. For most counties in California, you can request certified copies of your file or just a few pages, whatever you specify, via mail. It just takes a few weeks and of course you have to pay for the service and the copies they make.

The embassy has nothing that can help you. Just go online. I did I have a friend who is also abroad and lived in Sacramento. Just order it.

Once you have the new document in-hand, you only need to make a photocopy and include the photocopy in the I-130 package. USCIS only needs photocopies of documents.
