K1/K2 AOS filed but omitted to include fees

Hi Vjers,

Thank you so much for your very helpful contributions during our K1/K2 process..

My son and I arrived the us and my fiancee and I got married and filed for AOS before the end of the days unfortunately we forgot to include the check for the fees both on the cover letter and in the package.

Is our case going to be attended to with and RFE for the fees?

Please anyone with an idea of what to do in our case?

Just to second that, your packet will get sent back to you. Without the payment, they will not "accept" your AOS.

Is it possible for me to send the cheques as an addition to the documents we sent at first. Also our I-94 has expired, any risk to that?

No, as others have said. You will have to wait for them to reject your application packet and return it to you.

You have nothing to worry about your I-94 being expired. Just send those documents back with the check and all will be good.

i am having the same problem, i sent my application on Aug 3 2014 with no fees , the did reject it and i received the package back on the mail Aug 21 2014 with a rejection letter with is the bellow

We are sorry to inform you that we have rejected your application for the reasons indicated on the I-797 /reject Notice.

You are invited to resubmit your application package after you have corrected the reasons for rejection. If you have any questions please contact lockboxsupport@dhs.gov.

When you resubmit your application, please enclose this letter with your re-submission.

Place this letter on top of your application package.

the I797 says

This is in reference to the I-485, application to Register Permanent or Adjust Status, you submitted. Your I-485,

fees, and any supporting documentation is being returned to you for the following reason(s):

The check amount is incorrect, or has not been provided. Please review the Form Instructions for fee information.

Please resubmit the application/petition package with the appropriate fees to the address listed on the bottom of this page.

Please be sure to complete the application fully, submit the appropriate fees, and include all required supporting documentation.

Why K3, you were talking about K2? Which visa did the child have?

Why would you not adjust your son and get him a green card?

It is cheaper for him to adjust with you then to file separately from you.

Do the smart thing and adjust him when you file for yourself.

Parenting is about protecting your child.

By not adjusting your child, you put him in danger.

I would beg and borrow or sell my stuff to get the $500 (approximate) to adjust my child.

It is cheaper for him to adjust with you then to file separately from you.

It's $635 if the child is under 14, $720 if the child is 14 or over. But yes, why would you not do this? It's so so important and keeps your child legal. Sell, borrow etc to get the money you need.

There is no $720 fee for AOS.

If a child is under 14 and filing at the same time as the parent, then it is $635. If not filed with the parent, then it is $985.

If you are 14 and over, then the fee is $1070 ($985 + $85 bio fee), filed with parent or not.
