DV lottery Winner interview denied

Hello Folks,

I just got a call from home that a friend of mine has been denied visa from wining a DV lottery. Here is the story,him and his wife applied for the DV lottery and won the lottery and on the process had a kid which they added later (no problem). During the interview, questions were asked to the wife, husband and their response in one question was different - that is when did your wife go into labor for the baby to be born. The man gave a different time and the wife gave a different answer - This is where the interviewer stated that they could not determine their relationship and for that denied them visa. These couples are happily married and with one kid. There is no false alarm in the marriage. Just that the dude response on the question asked was different. Can they appeal for this case to be re-opened or use a lawyer - Please what can be done to have this case re-opened. The visa fees have been collected and they don't mind paying again

1-129F Journey:

Met my Fiancee: 1998 when i was a tutor in a High

1998 December: Became friends and started talking

2000 : Lost Contact and never met again

2003: Traveled to the States and still not talking

2005: Traveled back home and we met again ( serious here)

2007: I made up my mind that she is "the one"

2007 December 27th: Proposed to her

2009 May 12th: sent in the 1-129F for her

2009 May 19th: Receipt of NOA1

Sept 15th : NOA2 Approved email received

Sept 22nd: NOA2 Hard Copy received

Sept 16th: Package sent to NVC

Sept 17th: Package Received at NVC

Sept 21st: Package sent to Local Embassy.

Sept 26th : NVC Approval Letter received in the mail

Sept 28th: Package Delivered at Local Embassy (Lagos Nigeria)....Signed by Ben Obi by 10.50am.....yahooo..time to get ready for interview

NOV 20TH: Interview Date by 7.am...too early and i wonder what my woman will do since she is like 6hrs from the Location

MEDICAL: Done on 12th

Interview: PASSED on 20th without stress and not much questions......Glory be to God

Visa Picked up: Nov. 27th

Wedding: Dec 31st..... Got wedded and was fabulous

January 16th..... Wife entered US with me through IAD ,,,,,,NO EAD received

January 20th..... Got our Marriage License

February 14th .....Civil Marriage Date

2/06/13: APPROVED!

I am sure they can appeal but I doubt it will make a difference. I also believe your friend did not tell you the whole story - it is just to plain simple. I suspect there is more to the interview he is not telling you about.

There is no appeal in DV cases.

This story of the interview sounds odd to me. I'm sure there is more to the story than you have been told...the CO clearly suspects attempted visa fraud of some sort.

Well, i don't really know the full story but i was there in their marriage. There is no fraud in the marriage.

Well, i don't really know the full story but i was there in their marriage. There is no fraud in the marriage.

There was clearly something the CO was suspicious about that they could not allay. Regardless, there is no appeal for DV cases.

Unfortunately there is no time even if you could appeal. All visas for the current year must be issued before the end of the coming month. The only hope which would be a total long shot for Lagos is to call and ask for the supervisor to review the decision. There also is no next chance as Nigeria is no longer a country that plays the lottery. It is a shame that all the fees / medicals are for nothing.

This will not be over quickly. You will not enjoy this.

According to Lagos Consulate, there is no appeal for DV visas, the CO decision is FINAL. And the printer won't even allow them print any DV visa after September 30th. Your friend's experience is so sad. Nigerians no longer qualify for DV lottery again.
