EAD expedite NON finacial reason

Hello,

I have been an F1 student since Desember 2010, in January 2013 I started working as a TA for an electrical engineering professor at my school. I have been maintaining my status and working <20 hours/week. I got married in July 2014 and we filed i-130, I-485, I-765 concurrently in August ( view my timeline). I have graduated in May 2014 but was planning to take more courses ( for a double major) and the most important one got cancelled. My I-20 is until December 2014 as my school official was aware of my plans of taking additional courses for a double major. It is unreasonable for me to take a full load of courses this semester as the most important class got cancelled, so I cannot maintain F1 status and work for my professor anymore.

This professor is very sick and has been scheduled to go for treatments throughout Fall 2014 semester, so he will have to be absent from several classes and labs that he teaches. While I was working for him I would step in and lecture/do reviews/ help students with the lab work, as I am very familiar with all the material taught in classes. The engineering department really wants to keep me, as it is hard to find somebody who is as familiar with the materials taught in these classes.

Anyway, do you guys think it is reasonable to apply for EAD expedite based on these premises?

7/9/14 - Got married (L)

8/4/14 - Mailed I-130, I-485 and I-765 to Chicago lockbox

8/5/14 - Package delivered and signed by John

8/7/14 - Texts and emails with NOAs for I-130, I-485 and I-765. ~ Now I have case numbers I can go online 10 times a day and check!!!

8/13/14 - NOAs for I-130, I-485 and I-765 received in the mail. I have an alien number now.

9/2/14 - Biometrics done

9/8/14 - EAD approved!!! (expedited by the local congressman)

9/12/14 - EAD in hand!

Are they offering you a job? If so, yes, because you have a job offer that, based on the academic cycle, has to start at a specific time or the opportunity will be lost.

I do have a job offer. They need me to start before September 3rd.

I thought you had to have financial hardship evidence together with your job offer to be able to expedite.

Should I request an expedite before my biometrics appointment? Is it better to seek for assistance from a local congressman or do it on my own?

YOu can request an expedite on the basis of just a job offer - get the relevant documentation (official job offer letter) and its easy enough to do it on your own.

You'll need to do your biometrics, so walk-in if it's not this week.

Get the job offer in writing, on department letterhead, with the start date and how it's not flexible. Call and request the expedite (probably have to do a Tier II rep), and follow their instructions. Explain that you have an academic job offer, have to start on a set date, and this benefits you academically/professionally.

When you're done with them, immediately call your congresscritter, ask to talk to their immigration person, and explain the same thing: this benefits you academically, it's an academic position and thus starts at a specific time, this is a job offer so losing it isn't great, etc. Ask for their help in expediting; you'll have to fill out a permission form for them to intervene.

They should be able to get you expedited within a week, so long as you've done your biometrics.

(This is all based on how my husband expedited his EAD for an academic position.)

Thank you for a very detailed response!! I am still waiting on my biometrics appointment letter, as soon as I get one I will attempt a walk-in.

kehills, I have another question. While going through this forum I have found instructions on calling USCIS and requesting and expedite: ( found here http://www.visajourney.com/forums/topic/453753-how-to-request-to-expedite-your-ead-based-on-a-job-offer/ )

"I was given a list of reasons as to why my expedited EAD may be considered. These reasons are:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS "

Which reason should I choose? Which reason did your husband choose?

Can it be considered extreme emergent situation?

He wasn't given those reasons, so I don't know. :-) He just had a conversation with the Tier II rep, and it moved on quickly from there.

Just to give an update to the story:

My biometrics were scheduled for 9/2/14, I attempted a walk-in as soon as I got the notice with the appointment in the mail - Phoenix USCIS office didn't allow me to do a walk-in. So I decided to submit all necessary paperwork to the local congressman so they have it by the time my biometrics are done. I called the congressman office and got the information on the paperwork they needed and set up an appointment with them ( I prefer to do things in person and not over the phone/mail).

Paperwork they needed:

1. NOA for my I-765

2. Marriage certificate ( I changed my last name)

3. Job offer letter ( The department chair wrote a job offer letter for me explaining what an important asset I am and explained my duties in a lot of detail)

4. A personal letter from me explaining the whole situation and kind of tying all my paperwork together.

5. Signed information release consent.

I submitted everything to the congressman office about a week before my biometrics. The representatives were all very nice and accomodating, They assigned a person to my case, his name was Steve.

When I got my biometrics done on 9/2 I called and let Steve know about that change, he let me know that they have already submitted the expedite request on my behalf and were awaiting a response. On 9/9 I got a call from Steve with good news =) He congratulated me on my EAD approval and asked me for my email to send me a little bit more details on my case. In 10 minutes I got an email from him saying that my EAD should arrive in the mail within 2 weeks. There was also a little explanation on how my track my case ( haha I had been doing it 3 times a day every day ). He also said when my EAD gets mailed I will see a USPS tracking number when I track my case.

Note: I never called USCIS to request an expedite myself.

I am very excited and in a couple days I'm going to start stalking our mailman :content:
