K-1 Visa questions regarding age.

Hello all,

So my fiance and I are planning on going through the K-1 Visa route, we just have a few questions regarding our age. My Fiance is 23 and I'm 18, I'm just curious as to if we'll have to prepare a little bit more for our interview because of our age difference and I read somewhere that they generally look down on the man being younger than the woman. The question is, will we run into any major problems preventing us from getting the K-1?

We have met, I stayed with here from May 7th 2014 to July 10th 2014, we have various things proving we're a real couple (Pictures, boarding passes, hotel receipts even receipts for the Grand Canyon, Bearazona, Seaworld San Diego, Six Flags Magic Mountain, San Diego Zoo, we even have proof that we went to Silverton and Durango in Colorado as well as skype calls lasting anywhere from 5 hours - 15 hours long.)

We just want to be as prepared as possible before we start and we don't want to be rejected the privilege to live with one another because of silly little things such as my age.

We're aware of the tough road ahead and we're both very willing to go through all the bull dust just to be together.

You will have the same burden of proving your relationship is bona fide as all other applicants. Assuming you provide the evidence for this, which it sounds like you have, there shouldn't be a problem.

Hi, just wanted to mention that the age difference will not really matter, you just have to prove that the relationship is bona fide. My now husband is 12 yrs younger than me and they didn't give us a problem when we did the K-1 visa. So don't psych yourself out about the age difference. The only thing they asked about the age difference was if our families knew about the age difference.

5 years apart is not that unusual especially when both are so young.

I think you will be just fine.

However young people have trouble meeting the income guideline

so are you making above 125% of poverty guideline?

If not, you can always try to get a co-sponsor...like your parents or siblings.

We read somewhere that an attorney could wave most of the income requirements, in fact most of the requirements in general, besides the meeting and proving you're a real couple.

Is this not true? Because we were thinking about hiring an attorney to help my Fiance through it, would that be a good idea or not really?

How could an attorney wave what's required by US immigration?

US government wants to ensure that your husband doesn't become a public charge,

and wants to ensure that you and co-sponsors will be financially liable to provide the support,

even in the case of divorce.

My sister's relative is going through this right now.

One of their relative (on the husband side) is going through a divorce,

and soon to be ex-wife doesn't speak English, uneducated, never worked,

and have no intention to work, and divorce lawyer passed the warning to the parent

that co-signed that he could be on the hook to financially provide support to

his son's soon to be ex-wife.

The only way an attorney could help you is by becoming a co-sponsor himself,

but I highly doubt that a law savvy attorney would financially implicate himself to

such no win situation. Especially when considering high divorce rate in US.

Your 5 year age difference, even if the woman is older, is not really an issue. Not being able to meet the financial requirements is. An attorney cannot waive any of the USCIS or Dept. of State requirements. How could they? If they told you that, then run from them. They are lying, have no clue about immigration, or both. You need all the requirements listed in the I-129F petition instructions, and then later for the K-1 visa interview, you need all the DoS requirements listed in your consulate's instructions. One of those things will be the I-134 affidavit of support. After entering the US with the K-1 visa and getting married, you will need to provide another affidavit of support, the I-864, when you file for adjustment of status.

Do yourself a favor, and stay away from legal assistance. When I first started this process, I went for a consult with a lawyer. He charged me 100$ to tell me a bunch of ill-informed garbage. They will cost you money that you do not need to spend, and won't have their heart in it. If you do this yourself, you'll be able to give it the absolute most possible amount of care and precision that you can muster, which should ultimately lead to a speedy process.

The best thing that you can do to help you in all of this, is absolutely scour this site for information. There's a TON to be learned from VJ. My wife and I did everything ourselves (sometimes my wife did more than I did) and we had a very quick case with no RFE's or any other bumps in the road. Read all the guides. Print them out and have them handy when you're making your initial packet. If you have even the tiniest question (sign or not sign/copy or original) look it up.

A word of caution: Do not take what you read as gospel. This is an open user based FREE forum. Some people are not as educated in the immigration process as others. What worked for some people's case, may not hold up in yours. If you find an answer to a question, look at 2 or 3 more threads to verify it.

And finally, don't be afraid to post when you get stuck. There are a lot of people here who are eager to help you.

Dont get a lawyer, it's not difficult t do yourself, they cannot waive USCIS requirements, save yourself about $2500, read the guides on here several times, read your own embassy instructions and browse the forums here, let's face it your going to have the time to do so, it's not a quick process.

There are many helpful people on this forum in case you run into any issues with the paperwork. As long as you take the time to read the guides here and the paperwork from USCIS, there is no reason not to do it yourself. Saves a bunch of $. Good luck!
