Hello there, we are new to this process and we want to apply for the Visa K1. My concern is that I've never been in the US ever before, not even outside of Argentina (my homeland) would it be a red flag when we present the Form I-129F? we've been 4 years together and she came to my country twice already. Thanks in advance.

No, there is no red flags about never being in the US before. You should be just fine. Make sure you read the guide on Visa Journey and ask questions if you do not understand the whole process. People here are will gladly to help your immigration process. Good luck!

It will not raise red flags. However, you shouldn't just assume you will like it there. I recommend a visit.

I agree with Marco&Bettina You should have no problems visa-wise not visiting the US, but I am sure it would help you both if you visited the US before moving. I know it isn't always possible, but if you can make it happen, I would try. If you can't make a visit happen, then try not to worry about it and think of it as an exciting adventure (Getting married and moving to a new country!) and keep an open mind about things.

Good luck!

Also for the K-1 you have to have seen each other physically in the previous two years before you apply... you didn't say when she last came to see you.

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

So sounds like she is the US Citizen, then it should not be a problem.

However, I know she has visited you twice, but the physical meeting has to be

within the past 2 years and you guys have to have proof (plane tickets, passport visa/stamps, pictures, etc.)

Definitely not a red flag, as long as you both are legally free to marry upon filing the I-129f.

You and fiancee should really read over the following on (I-129F/K1 visa).

It will save you time and headache later. Yes, it's a lot of information,

and I'm 9 months into this, and I am still going back and reading some of these.

And double and triple check everything for accuracy and completeness,

because any glitch can mean weeks of delay.

Good luck.

My (now-)wife had never been to the U.S. or even out of Colombia before we filed for her K-1. I went there to visit her several times before (and after) filing the I-129F. Your never having been in the U.S. or leaving Argentina will not affect your K-1 process. As long as the two of you have been together sometime, somewhere during the last 2 years, you will be OK.

And, if you could visit the U.S., it would be great for your own personal peace of mind, but understand that it can't always be done. Those from Visa Waiver Program countries/Canada have far easier paths to visit the U.S. than others do.

The process will seem like it is taking forever but relax and everything will be OK. Best of luck!
