outcome of Adjs. after K1 Visa without Sponsor?

Hi All, I entered by K1, married and now applying for adjustment of status. My husband income tax filed around 5000 and we can not afford joint sponsor, what happens if we send documents as is?.... after NOA, we can just say that we do not have co-sponsor... will be considered out of status? Illegal? or be instructed to deport?

i don't get it. your husband's income last year was $5000? was that a partial year income? does he have a job now? if his current salary is above the projected poverty line, you will just need to show proof of employment from employer with salary/income/wages and send copies of his last few paychecks. if those are fine you won't need a joint sponsor. i find it hard to believe that you guys are surviving in the US with that kind of low income and not living with someone else who is helping support you.... i mean the application alone is around $1050...

It's not what your husband made last year, but rather how much he is making now. Is his income above the poverty level of 125%?

And what exactly do you mean you can't "afford" a joint sponsor? You don't pay for one, you just ask someone you know that is willing to sign the I-864 and be responsible.

What will happen if you send everything as is without meeting the sponsor requirements, is that your AOS will be denied based on the likelihood of becoming a public charge.

What do you mean his income is $5,000??? How did you enter on a K1? Did he have current income that met the requirements for the I-134?

What do you mean you "cannot afford joint sponsor" - you don't pay anyone to be a joint sponsor..

If you cannot provide evidence of current income (As in pay stubs from now, not previous income on a tax return) to meet 125% of the poverty guideline for your household size as requirement for form I-864 then your AOS will be denied and you will asked to leave. You will be out of status, and illegal.

Actually it's a long story, their accountant made a mistake and filed 2013 tax at 5000$; IRS checked & fined at30,000...

Anyway, the available tax shows 5000,and I do not know if I can clear the matter with immigration,...

Also, we found nobody for co-sponsor, while we have enough money in my bank account and liquifiable properties in my homeland. But I do not know it works or not?

Aside from the accountant issues, what is the us petitioners CURRENT income? As in , how much does he make from his job? This is what matters, not the tax return amount. Although you will need to show the most recent tax year's return, they want to see current income, which are pay stubs/pay slips/letter from employer.

Get the tax return amended so it shows the correct income he actually made. Not sure how the mistake happened. Being self-employed, he needs to show he meets the requirement by what is listed as his Total Income on line 22 of the 1040. On top of that, you can also list your assets on his I-864. Provide proof of ownership and value.
