My wife abandoned me during her first green card, and has been gone over a year now.

I just received a letter about I-751 the other day, and I don't know what I should do about it. She doesn't want me to do anything, because it is "her case" and we're getting a divorce.

No. You're her sponsor regardless of what she does (until she abandons her green card or becomes a citizen). Nothing to discuss with USCIS.

if as you say she has been out of the country for more than a year and never came back, she has abandoned her GC, meaning she already lost her GC

It can't hurt by making an InfoPASS appointment to talk to someone at your local office, but yes people are right just move on with your life as she abanconded the gc and can't do anything about it.

<p>The letter was sent to me (her last known address), and didn't seem like they knew she had been gone over the limit. So, I wasn't sure if she could still apply, as it said an interview MAY be needed. Plus, I really don't want her to be able to get a visa so easily in the future.</p>

Whether it came in her name or not, I've done everything else regarding her immigration for her. Plus, we're still legally together. Additionally, if she could apply from outside the country without them finding out, it could be a nice bargaining chip.

Well it IS a federal offense to open mail not addressed to you, even if it's to your address. And what do you mean by bargaining chip? It sounds like you could be setting yourself up for legal trouble.

If she's been out of the country for over a year, she probably can't remove conditions on her green card anyway. Just divorce and be done with it.

I am pretty sure it is illegal to open the letters of your estranged wife, even if you are still legally married. You seem to be more preoccupied with it all than she is. The financial responsibilities may only be enforced after a continuous 5 years residency in one state, and by then most chose to become citizens. In reality, the chances of you being held finiancially responsable are almost null. Divorce and move on. And return pieces of mail that are not addressed to you.

BTW, she can apply from outside the country if she wants. The letter was just a reminder to her that it is time to remove conditions, that's all. Some might not even get one.

If they have given you written consent, I don't think opening another person's mail is illegal. Furthermore, I still want to know that she's going to have a hard time ever getting back in this country.
